Implementation plan for the implementation of the Petroleum Law 2022

Decision 1135/QD-TTg of 2023 on the Plan to implement the Petroleum Law in 2022 issued by the Prime Minister.

The Petroleum Law 2022 was passed by the 15th National Assembly on November 14, 2022 at the 4th Session, taking effect on July 1, 2023.

In order to implement the Petroleum Law 2022 promptly, consistently, and effectively, the Prime Minister issued the Plan to Implement the Petroleum Law 2022 with the following contents:

(1) Organize thorough dissemination, propaganda, and dissemination of the content of the Petroleum Law 2022

The Ministry of Industry and Trade presides over and coordinates with ministries, ministerial-level agencies, Government agencies, and relevant agencies and organizations to thoroughly organize the implementation of the law; propagate and disseminate the content of the Petroleum Law 2022 through columns, programs, training, document compilation, and other forms according to the provisions of the Law on Legal Dissemination and Education.

Implementation time: in 2023 and following years (if necessary).

(2) Review and develop legal documents to amend, supplement, replace, and annul legal documents to comply with the Law

- Develop legal documents detailing the assigned contents of the Petroleum Law 2022.

Develop a Decree detailing a number of articles of the Petroleum Law (replacing Decree 95/2015/ND-CP and Decree 33/2013/ND-CP) according to the assigned tasks in Decision 1529/QD-TTg in 2022 of the Prime Minister promulgating the List and assigning agencies to preside over the drafting of documents detailing the implementation of laws and resolutions approved in the 15th National Assembly at Session 4.

- Organize the review and propose amendments and supplements to the Decree promulgating the charter of organization and operation of Vietnam Oil and Gas Group.

+ Responsible agency: Ministry of Industry and Trade and Committee for Management of State Capital at Enterprises.

+ Coordinating agency: Government Office, Ministry of Justice, Ministry of Finance, Ministry of Planning and Investment, Vietnam Oil and Gas Group, and relevant ministries and branches.

+ Implementation time: in 2023 (depending on the proposal of the Committee for Management of State Capital at Enterprises and Vietnam Oil and Gas Group).

- Organize review and propose amendments and supplements to the Decree stipulating penalties for administrative violations in the fields of oil and gas, petroleum, and gas trading (if necessary).

+ Responsible agency: Ministry of Industry and Trade.

+ Coordinating agency: Government Office, Ministry of Justice, and relevant ministries and branches.

+ Implementation time: 2023–2024.

- Organize the review and propose amendments and supplements to the Decree promulgating the Financial Management Regulations of the Parent Company - Vietnam Oil and Gas Group.

+ Responsible agency: Ministry of Finance.

+ Coordinating agency: Government Office, Ministry of Industry and Trade, Ministry of Justice, Committee for Management of State Capital at Enterprises, Vietnam Oil and Gas Group, and relevant ministries and branches.

+ Implementation time: 2023–2024.

- Organize a review to amend and supplement Circulars of the Ministry of Industry and Trade guiding contents related to oil and gas activities (depending on the review results).

+ Responsible agency: Ministry of Industry and Trade.

+ Coordinating agency: Vietnam Oil and Gas Group and relevant ministries and branches.

+ Implementation time: 2023–2024.

- Organize a review to amend and supplement Circulars of the Ministry of Finance guiding tax content in oil and gas activities (depending on the review results).

+ Responsible agency: Ministry of Finance.

+ Coordinating agency: Vietnam Oil and Gas Group and relevant ministries and branches.

+ Implementation time: 2023–2024.

(3) Carry out state management responsibilities for basic surveys of oil and gas and oil and gas activities

- At Central

+ Responsible agency: Ministry of Industry and Trade.

+ Coordinating agency: Government Office, Ministry of Justice, Ministry of Natural Resources and Environment, ministries, ministerial-level agencies, and other relevant agencies and organizations.

+ Implementation time: annually.

- Locally

+ Lead agency and coordinating agency: decided by the People's Committees at all levels.

+ Completion time: every year.

(4) Monitor the implementation of oil and gas laws

+ Responsible agency: Ministry of Justice.

+ Coordinating agency: relevant ministries, branches, and localities according to assigned functions and tasks.

+ Implementation time: annually.
