Hanoi: Unit's personnel may propose to extend the working time of managerial public employees in Vietnam
Specifically, in Article 45 of Decree 115/2020/ND-CP, the responsibilities and authority in the appointment process of management officials extending their work time until retirement age are stated as follows:
- Heads, members of the party committee, and leaders of agencies and units are responsible for proposing personnel and giving opinions, and evaluations on the proposed personnel.
- The collective party committee, the collective leadership of the agency, and the unit will discuss, comment, evaluate, make decisions, or propose to the competent authority for consideration and decision.
- Individuals or collectives proposing appointments must be accountable to the competent authority for their opinions, evaluations, and conclusions on political standards, moral qualities, lifestyle; work capacity, strengths, and disadvantages of the proposed personnel.
- The advisory department on organizational affairs and related agencies/units are responsible for evaluating and proposing personnel according to their functions, tasks, and authority.
- The collective leadership and the head making the appointment decision are responsible for their decisions; lead and direct the inspection, supervision, and handling of violations regarding personnel affairs.
- Public employees proposed for appointment must be accountable for declaring their background, personal dossiers, assets, and income declaration, and explaining related contents.
- The authority to appoint public employees to management positions is decided by the head of the public service provider or proposed to the competent authority for decision according to the management hierarchy of personnel affairs. In case there are other specific regulations regarding the authority to appoint managerial public employees, then those regulations are to be followed as per specialized legal provisions.
