Court fees are the costs of adjudicating a case that the parties involved must pay in each case as stipulated by the competent state authorities. Advance payment of court fees is the upfront payment to ensure the obligation of paying court fees.
According to regulations, the following litigants are exempt from paying advance money and court fees:
- Workers filing lawsuits to claim wages, job loss allowances, severance pay, social insurance, compensation for labor accidents, occupational diseases; resolving compensation issues or due to wrongful dismissal or unlawful termination of labor contracts;- Workers claiming compensation or filing lawsuits due to wrongful dismissal or unlawful termination of labor contracts;- The grassroots trade union executive committee filing lawsuits for the interests of collective labor.
Grassroots trade unions, provincial-level trade unions, and sectorial trade unions that file lawsuits or appeals are not required to pay advance court fees, nor are they liable for first-instance and appellate court fees.
The Procuracy initiating a prosecution or appeal is not required to pay advance court fees, nor are they liable for first-instance and appellate court fees.
In cases where the litigant is a worker who does not fall into the above categories and has financial difficulties as certified by the commune-level People's Committee, the Court may exempt them from paying part or all of the advance court fees and court fees.
