On August 22, 2014, the Ministry of Natural Resources and Environment issued Circular 48/2014/TT-BTNMT specifying the technical standards for determining administrative boundary lines, setting boundary markers, and preparing administrative boundary records at all levels.
Establishing the Legal Status of Documents in Administrative Boundary Delimitation Dossiers at All Levels (Illustration)
Circular 48/2014/TT-BTNMT regulates the establishment of the legal status of documents in administrative boundary delimitation dossiers at all levels, including commune, district, and provincial levels as follows:
- The Chairman of the People’s Committee at commune, district, and provincial levels signs the confirmation outside the southeastern frame corner of each map sheet in the set of administrative boundary delimitation maps within their administrative management scope;- The Chairman of the People’s Committee at commune, district, and provincial levels concerned signs the confirmation within the content of each map sheet of administrative boundary delimitation in the area within their administrative management and at a distance of 2cm to 3cm from the common boundary line with the level preparing the dossier.
- The Chairman of the provincial People’s Committee directly managing the administrative boundary marker signs the confirmation on the provincial administrative boundary marker position diagram, and the representative of the Ministry of Home Affairs signs to certify the provincial administrative boundary marker position diagram;- The Chairman of the district People’s Committee directly managing the marker signs the confirmation and the Chairman of the provincial People’s Committee signs to certify the district administrative boundary marker position diagram;- The Chairman of the commune People’s Committee directly managing the marker signs the confirmation and the Chairman of the district People’s Committee signs to certify the commune administrative boundary marker position diagram.
- The Chairman of the People’s Committee at the management level directly overseeing the administrative boundary marker signs the confirmation on the coordinate confirmation of the corresponding level’s administrative boundary markers;- The representative of the construction unit signs the confirmation; the person drafting and the person checking sign and state their full names.
- The Chairman of the People’s Committee at all levels signs the confirmation;- The drafter signs and states their full name.
- The Chairmen of the People’s Committees of the two concerned communes sign the confirmation;- The representatives of the district-level specialized agencies, including the Department of Home Affairs and the construction unit, sign as witnesses.
Establishing the legal status on the confirmation description of the administrative boundary line at the district and provincial levels by the direct signing of the Chairmen of the People’s Committees at the district and provincial levels concerned.
Establishing the legal status on the statistical form of place names (inhabitants, hydrography, topography) within the administrative area of the commune, signed by the Chairman of the commune People’s Committee, and the drafter signs and states their full name.
Establishing the legal status on the delivery minutes of administrative boundary markers at all levels:
- The Chairman of the provincial People’s Committee signs the confirmation for the delivering party;- The Chairman of the commune People’s Committee signs the confirmation for the receiving party.
