The Minister of Construction of Vietnam promulgates Circular 14/2024/TT-BXD dated December 30, 2024, concerning the Procedure for Assessing Construction Safety during Operation and Use.

According to Article 12 of the Procedure for Assessing Construction Safety during Operation and Use issued in conjunction with Circular 14/2024/TT-BXD, the construction safety assessment documentation during operation and use is as follows:

- The construction safety assessment documentation prepared by the assessment organization includes: a report on the construction safety assessment results and relevant dossiers and materials (assessment outline; drawings, photographs of the construction status; results of surveys, measurements of current construction status; results of testing construction material structures; results of structural analysis and inspection, etc.).

- The construction safety assessment documentation is handed over to the owner or the person managing and using the construction for storage in the maintenance file and to serve the next assessment.

Guidelines for preliminary assessment of construction during operation and use in Vietnam

According to Article 10 of the Procedure for Assessing Construction Safety during Operation and Use issued in conjunction with Circular 14/2024/TT-BXD, guidelines for preliminary safety assessment during operation and use are as follows:

- The sequence for conducting a preliminary assessment is as follows:

+ Study the dossiers, materials, and other signs;

+ Survey the current construction status;

+ Conduct a preliminary assessment;

+ Compile a report on the results of the construction safety assessment.

- Dossiers, materials, and other signs needing study during the preliminary assessment include:

+ The dossiers, materials specified in Clause 2, Article 8 of the Procedure for Assessing Construction Safety during Operation and Use issued in conjunction with Circular 14/2024/TT-BXD;

+ Other signs (examples: changes in land conditions, corrosion, etc.).

- Surveying the current construction status during the preliminary assessment phase is to clearly identify the structural system and the defects, damages, deformations of the structure, material deterioration by visual inspection methods using simple equipment and tools. Before surveying the current construction status, the assessment organization must study the dossiers and materials to identify the load-bearing structure, important structure, special structure, static structure.

- During the preliminary assessment phase, based on the results of studying dossiers, materials, other signs, and surveying the current construction status, the assessment organization must determine the severity of defects, damages, deformations, structural changes, material deterioration affecting load-bearing safety and normal usage conditions of the structure to concentrate resources on these factors in subsequent assessments. Based on the preliminary assessment results, the assessment organization recommends whether or not additional surveys are necessary.

- In case the preliminary assessment results indicate that the construction structure poses a safety risk, the assessment organization must promptly notify the owner, manager, or user of the construction to take remedial measures (if necessary) to prevent or minimize danger to public safety.

- Based on the survey and assessment results in accordance with points b and c, Clause 1, Article 10 of the Procedure for Assessing Construction Safety during Operation and Use issued in conjunction with Circular 14/2024/TT-BXD, the assessment organization recommends whether or not a detailed assessment is necessary. A detailed assessment is not required if the preliminary assessment can conclude that the construction structure is safe or unsafe. If the preliminary assessment cannot conclude whether the construction structure is safe or unsafe, a detailed assessment is recommended according to Article 11 of the Procedure for Assessing Construction Safety during Operation and Use issued in conjunction with Circular 14/2024/TT-BXD.

- Report on the results of the construction safety assessment

+ The report on the results of the construction safety assessment must reflect the actual work inspections carried out and clearly present the evaluations, conclusions, and recommendations (if any).

+ The main contents of the construction safety assessment report include: general information about the construction; information about the assessment organization; subject of assessment, time of assessment; list of dossiers and materials serving the assessment; survey, inspection, and assessment results carried out; conclusions, recommendations (if any); full name, signature of the individual in charge of conducting the assessment; full name, signature, position of the legal representative, and seal of the legal entity of the assessment organization.

Circular 14/2024/TT-BXD takes effect from February 19, 2025.
