Delivery, Receipt, and Transportation of State Secret Documents and Items

The Ministry of Natural Resources and Environment issued Circular 11/2017/TT-BTNMT on June 29, 2017, detailing the regulations on the delivery, receipt, and transportation of documents and items containing state secrets.

To be specific, Circular 11 stipulates that in all cases of transferring and receiving documents and materials containing state secrets, a confidential document transfer log must be maintained, which must be signed by both the sender and the recipient; for documents and materials containing state secrets marked “Top Secret,” the content summary shall not be recorded in the confidential document transfer log unless permitted by the authorized person.

The transfer and receipt of documents and materials containing state secrets must be carried out directly at the workplace, ensuring safety according to the regulations of the head of the agency or unit that possesses the documents and materials containing state secrets. Both parties involved in the transfer and receipt of documents and materials containing state secrets must organize checks and comparisons to detect any errors or losses for prompt handling as prescribed by law.

The transportation of documents and materials containing state secrets is to be conducted by officials and public employees responsible for state secret protection work or clerks of the agency or unit.

When transporting documents and materials containing state secrets, there must be adequate facilities to ensure their preservation, carrying, and custody; in all cases, a responsible person must be appointed to carefully guard and ensure the absolute safety of the various types of documents and materials containing state secrets; if transportation and delivery are carried out via postal service, it must comply with the separate regulations of the postal sector.
