Conditions for issuance of electric power operation licenses in Vietnam from February 1, 2025​

According to Article 31 of the Law on Electricity 2024, to be granted an electricity operation license from February 1, 2025, the following conditions must be met:

(1) The organization issued an electricity operation license must meet the following conditions:

- Legally established according to the provisions of the law;

- Have a technical management team, business management team, and a team directly involved in operational work meeting the required quantity and professional qualifications.

(2) For the fields of electricity generation, electricity transmission, and electricity distribution, the organization issued an electricity operation license must meet the conditions specified in (1) and the following conditions:

- Have project items, electricity generation works, electricity transmission, electricity distribution that comply with the electricity development plan, electricity grid development plan in provincial planning, implementation plan of the electricity development plan, implementation plan of provincial planning including the content of the electricity grid development plan and adjustment decisions (if any); are constructed and installed according to the approved design, meeting the conditions for exploitation and use;

- Have projects, electricity generation, transmission, and distribution works constructed and installed in compliance with the legal provisions on marine, land, fire prevention, firefighting and rescue, environmental protection, and other relevant legal regulations;

- Have safety management documents for dams, water reservoirs according to legal provisions for hydropower electricity generation.

(3) For the fields of electricity wholesale and retail, the organization issued a license must meet all conditions specified in (1) and have a suitable electricity wholesale and retail operation plan.

Cases for issuance of electric power operation licenses in Vietnam from February 1, 2025

According to Article 32 of the Law on Electricity 2024, the cases for issuing electricity operation licenses from February 1, 2025, are as follows:

- Issuance of a new electricity operation license in the following cases:

+ First-time license issuance for a project item or entire project in the field of electricity generation;

+ First-time license issuance for specific scopes in the field of electricity transmission, electricity distribution, electricity wholesale, electricity retail;

+ Issuance of a new electricity operation license in case of changes in the scope of activities, main technical specifications of electricity works, technology used in electricity activities of the issued license.

- Issuance of amended or supplemented electricity operation licenses in the following cases:

+ At the request of the licensed organization when there are changes in any content of the electricity operation license as stipulated in Clause 1, Article 34 of the Law on Electricity 2024 or reduction in the field of electricity operation as specified in Clause 2, Article 34 of the Law on Electricity 2024;

+ At the request of the competent state management authority in cases necessary to protect national defense security interests, socio-economic interests, public interests;

+ There are errors in the content recorded in the issued license.

- Re-issuance of electricity operation licenses in the following cases:

+ At the request of the licensed organization in case the license is still valid but is lost or damaged;

+ When the issued license is valid for less than 6 months or expires, and upon the request of the licensed organization. In this case, the contents of the license stipulated in Clauses 2, 3, and 4 of Article 34 of the Law on Electricity 2024 remain unchanged from the issued license;

+ As stipulated in Clause 2, Article 36 of the Law on Electricity 2024.

- The case where the Electricity Operation License is extended upon the request of the licensed organization when the time from the expiration of the license to the asset, electricity work transfer date or project cessation date does not exceed 12 months. The license is extended once and the duration of the extended license does not exceed the asset, electricity work transfer date or project cessation date.
