Cases Allowed to Delay Sending Electronic Data

The content is stipulated in Circular 48/2017/TT-BYT issued by the Ministry of Health on December 28, 2017, regulating the extraction and transfer of electronic data in the management and payment of health insurance examination costs.

Circular 48 stipulates that electronic data serving the management, assessment, and payment of medical examination and treatment costs covered by health insurance is permitted to be sent later than the timeframes specified in this Circular in the following cases:

- Due to objective, force majeure incidents causing the information technology infrastructure system to be unable to meet the requirement for extracting, transferring, or receiving electronic data.- The information technology infrastructure system cannot meet the requirement for extracting, transferring, or receiving electronic data due to power outages or the absence of an Internet connection.

Additionally, Circular 48 stipulates that when objective, force majeure incidents occur from the side of the medical examination and treatment facility sending electronic data or from the side of the agency receiving electronic data, the party experiencing the incident is responsible for immediately notifying the other party of the cause of the incident. Notifications can be made via telephone, email, or in writing. Electronic data will continue to be sent and received immediately after the incident has been corrected and resolved.

In cases due to technical causes, the form and timing of sending electronic data will be decided by the Head of the medical examination and treatment facility and the head of the Social Insurance agency contracting health insurance with that facility and must be clearly stated in the health insurance medical examination and treatment contract. Additionally, the head of the medical examination and treatment facility and the head of the Social Insurance agency are responsible for reporting in writing to their direct governing bodies.
