This is an important content mentioned in Circular 19/2015/TT-BTP stipulating the legal examination carried out by the Head of the District Justice Department for dossiers proposing the application of administrative handling measures to send individuals to reformatory schools, compulsory education institutions, and compulsory rehabilitation centers, issued by the Ministry of Justice on December 28, 2015.
According to the provisions of Circular 19/2015/TT-BTP, depending on each case, the authority to prepare the dossier proposing the application of the measure to send individuals to compulsory education institutions will vary. To be specific:
- In the case where the violator has a stable residence, the President of the Commune People's Committee where the violator resides has the authority to prepare the dossier proposing the measure to send the violator to a compulsory education institution.- In the case where the individual does not reside at the place where the violation occurs and the residence of the individual can be determined, the President of the Commune People's Committee where the violator resides has the authority to prepare the dossier proposing the measure to send the violator to a compulsory education institution.- In the case where the individual does not reside at the place where the violation occurs and the residence of the individual cannot be determined, the President of the Commune People's Committee where the individual being proposed to apply the administrative handling measure violated the law has the authority to prepare the dossier proposing the measure to send the violator to a compulsory education institution.- …
