Assessment of Codification Results by Subject

According to the provisions in the Ordinance on Codification of the System of Legal Normative Documents 2012, the codification by subject must be appraised for results by the Appraisal Council. So, specifically, how is this appraisal regulated?

According to the provisions of Articles 10, 11, and 12 of the 2012 Ordinance on Codification of the Legal Normative System, the Minister of Justice decides to establish the Appraisal Council to appraise the codification results according to the subject.

The Appraisal Council is chaired by the Minister of Justice. Members of the Appraisal Council include representatives of the leadership of the codification-implementing agency, the National Assembly's Legal Committee, relevant agencies and organizations, and some legal experts.

The appraisal content of the codification results according to the subject focuses on the following issues:

1. The accuracy and completeness of the legal norms in the subject.

2. The appropriateness of the position of the legal norms in the subject.

3. Compliance with the procedures and order of codification according to the subject.

4. Other issues related to the content of the subject.

The conclusion of the Appraisal Council must be sent to the codification-implementing agency within 30 days from the date of receiving the appraisal request dossier.

Within 15 days from the date of receiving the conclusion of the Appraisal Council, based on this conclusion, the codification-implementing agency shall amend and complete the codification results according to the subject.

The head of the codification-implementing agency shall sign to certify the codification results according to the subject and send them to the Ministry of Justice. The Ministry of Justice shall arrange the codified subject into a theme.

The Government of Vietnam decides to approve the codification results according to each theme of the codification at the request of the Minister of Justice. The Ministry of Justice arranges the approved codification results by theme into the Code and publishes them on the Codification Information Portal.
