On May 29, 2015, the Ministry of Industry and Trade of Vietnam issued Circular 09/2015/TT-BCT stipulating the order and procedures for approving the policy for buying and selling electricity with foreign countries.

Article 5 of Circular 09/2015/TT-BCT stipulates that the appraisal and approval process of the electric power purchase and sale policy with foreign countries are as follows:
1. Vietnam Electricity Corporation is responsible for preparing and directly submitting the Dossier as prescribed in Article 4 of this Circular to the Electricity Regulatory Authority of Vietnam for appraisal.
2. In case the Dossier is not valid, the Electricity Regulatory Authority of Vietnam is responsible for notifying in writing and requesting Vietnam Electricity Corporation to supplement the dossier within 05 working days from the receipt of the Dossier.
3. Within 10 working days from the date of receiving a valid Dossier, the Electricity Regulatory Authority of Vietnam is responsible for:
- Leading the organization of the appraisal of the Dossier proposing the approval of the electric power purchase and sale policy with foreign countries for export and import electricity projects;
- Collecting written opinions about the plan for the purchase and sale of electricity with foreign countries for export and import electricity projects from the following agencies and units: Relevant Ministries and sectors for export and import electricity projects connected at a voltage level of 220 kV or more; Relevant electricity units for export and import electricity projects connected at a voltage level below 220 kV;
- Requesting Vietnam Electricity Corporation to explain the appraisal opinions or organizing for the Appraisal Agency to inspect and evaluate the export and import electricity project on-site when necessary.
4. Within 15 working days from the date of expiration of the time limit for collecting written opinions from relevant Ministries, sectors, and electricity units about the plan for purchasing and selling electricity with foreign countries, the Electricity Regulatory Authority of Vietnam is responsible for completing the appraisal report to submit to the Minister of Industry and Trade for:
- Submission to the Prime Minister of the Government of Vietnam for approval of export and import electricity projects connected at a voltage level of 220 kV or more;
- Approval of export and import electricity projects connected at a voltage level below 220 kV.
