New Regulations on Official Personnel Quota from July 20, 2020

On June 1, 2020, the Government of Vietnam issued Decree 62/2020/ND-CP regarding job positions and official staff size. This Decree includes new regulations on adjusting the official staff size and becomes effective from July 20, 2020.

1. Basis for determining official staffing

The basis for determining official staffing includes:

- Job positions and the workload of each job position;- The degree of modernization of equipment, means of work, and application of information technology;- The actual use of the assigned official staffing;- For agencies and organizations at the local level, in addition to the above-mentioned bases, it is also necessary to consider the population size, natural area, the number of administrative units at district and commune levels, and characteristics of political security, order, and social safety.

2. Procedure for annual approval of official staffing

Step 1: Agencies and organizations under ministries, central authorities, and local authorities, based on Clause 2, Article 4 of Decree 62/2020/ND-CP and guidelines from the competent authorities on official staffing quotas, develop annual official staffing plans for their agencies and organizations, sending them to the personnel organization authorities of ministries, central authorities, and local authorities for dossier reception and appraisal of the annual official staffing plans.

Step 2: The personnel organization authorities of ministries, central authorities, and local authorities receive dossiers, appraise annual official staffing plans of agencies and organizations; compile and develop the annual official staffing plans of ministries, central authorities, and local authorities to send to the Ministry of Home Affairs for appraisal.

Step 3: The Ministry of Home Affairs appraises the annual official staffing plans of ministries, central authorities, and local authorities; compiles the annual official staffing plans of ministries, central authorities, and local authorities to submit to the Prime Minister of the Government of Vietnam for approval; decides the official staffing for each ministry, central authority, and local authority after being approved by the Prime Minister of the Government of Vietnam.

3. Contents of the annual official staffing plan

The contents of the annual official staffing plan include 5 sections:

- The necessity of preparing the annual official staffing plan;- Report evaluating the assignment and use of official staffing for the previous year adjacent to the planning year at the time of plan preparation;- Determining the official staffing of the planning year; including statistics and summary of official staffing figures of the planning year according to Appendix IA or Appendix IB issued with Decree 62;- Solutions for implementing the official staffing plan after being assigned or approved by the competent authority, estimating the source of additional or replacement officials, implementing downsizing policies, and estimating the budget for implementation;- Recommendations and proposals.

4. Dossier of the annual official staffing plan

The dossier of the annual official staffing plan includes:

- Document requesting the annual official staffing plan;- Annual official staffing plan of the agency or organization according to regulations;- Copies of documents from the competent authority or person with authority deciding or approving the official staffing for the previous year adjacent to the planning year.

5. Cases for adjusting official staffing within agencies and organizations

Adjusting official staffing within agencies and organizations is considered in the following cases:

- Agencies or organizations have changes in one of the bases stipulated for determining official staffing;- Establishment, reorganization, or dissolution of agencies or organizations as per decisions from competent authorities; establishment, dissolution, merger, division, or adjustment of administrative unit boundaries at the provincial or district levels.

6. Dossier and procedure for adjusting official staffing

The dossier for adjusting official staffing includes:

- Document requesting the adjustment of official staffing;- Scheme for adjusting official staffing;- Relevant documents pertaining to the adjustment of official staffing;

For increasing official staffing or reallocating official staffing between ministries, central authorities, and local authorities, the ministries, central authorities, and local authorities send the dossier for adjustment of official staffing to the Ministry of Home Affairs for appraisal and submission to the Prime Minister of the Government of Vietnam for a decision.

For reallocating official staffing between ministries, central authorities, and local authorities and the agencies and organizations specified in Clause 1, Article 21 of Decree 62/2020/ND-CP, the ministries, central authorities, and local authorities send the dossier for reallocating official staffing to the Ministry of Home Affairs for decision. The Ministry of Home Affairs compiles and reports to the Prime Minister of the Government of Vietnam when submitting the annual official staffing for approval by the Prime Minister of the Government of Vietnam.
