How to change the content of the working contract in Vietnam?

A working contract is a contract signed between an employee and a public service unit. So if a person want to change the content of a working contract, what are the procedures in Vietnam?

Clause 1, Article 28 of Vietnam's Law on Public Employees 2010, Article 13 of Vietnam's Circular 15/2012/TT-BNV, stipulates changes in the content of the working contract as follows:

- The right to request changes to the contents of the working contract in Vietnam:

During the performance of a work contract, both public employees and public non-business units have the right to request changes to the contents of the work contract.

- The procedures of changing the contents of the working contract of Vietnam:

+ Step 1: The party making the request to change the contract content shall notify the other party at least three working days in advance.

+ Step 2: The two parties reach an agreement on the change to the working contract's content.

+ Step 3: Resolve the request to change the content of the work contract:

Case #1: If the two parties can reach an agreement, they will sign a contract addendum or sign a new working contract with changed contents.

Case #2: If the two parties cannot reach an agreement, they shall continue to perform the signed work contract or agree to terminate the working contract.

Note: During the negotiation period, the parties still have to abide by the signed working contract.
