Law amending and supplementing the Law on Cadres, Officials and the Law on Public Employees
Specifically, according to the regulations at Clause 15, Article 1 of the Law amending and supplementing certain articles of the Law on Cadres and Officials and the Law on Public Employees:
"Officials sentenced to imprisonment without probation or convicted of corruption offenses by the court will automatically be dismissed from the date the judgment or decision takes legal effect; officials holding leadership or managerial positions convicted by the court, and the judgment or decision has taken legal effect, will automatically cease to hold the appointed position."
It can be seen that this new regulation is reasonable. Because, according to the provisions of Clause 1, Article 92 of the Anti-Corruption Law 2018:
"Persons committing acts of corruption holding any position or job must be strictly dealt with according to the provisions of law, including retired, resigned, or transferred persons."
Therefore, this new regulation of the Amended Law shows consistency in the fight against corruption with other laws. Thus, it helps the anti-corruption work to be more drastic and strict.
In addition, the Amended Law also emphasizes that salary demotion only applies to officials not holding leadership or managerial positions (currently, this form is generally applied to all violating officials).
