Fostering Vietnamese officials and public employees from December 10, 2021: 5 new points to know

From December 10, 2021, the training and retraining of cadres, civil servants and public employees will have many notable new changes according to Decree 89/2021/ND-CP of Vietnam, specifically:

1. Vietnamese officials do not need to train as apprentices from December 10, 2021

According to Decree 89/2021/ND-CP of Vietnam, there will be 4 forms of training for cadres, civil servants and public employees, including:

- Training according to the standards of civil servant ranks, standards of professional titles of public employees.

- Training according to the standards of positions, leadership and management titles.

- Training according to the standards of positions and titles of commune-level cadres and civil servants.

- Training according to job position requirements.

Thus, compared with Decree 101/2017/ND-CP, Decree 89/2021 of Vietnam no longer stipulates the form of apprenticeship training for officials and public employees from December 10, 2021.

2. Remove the content of fostering ethnic languages, informatics and foreign languages in Vietnam

Currently, Decree 101/2017 of Vietnam stipulates 5 training contents for officials and public employees. However, Decree 89/2021 has removed the content of fostering ethnic languages, informatics and foreign languages. According to the Decree, from December 10, 2021, there are 4 training contents including:

- Political theory.

- Knowledge of defense and security.

- Knowledge and skills of state management.

- Knowledge and skills required by job position.

3. Change the training time in Vietnam

According to Decree 89/2021 of Vietnam, from December 10, 2021, training programs and materials are implemented as follows:

* Programs and materials for fostering knowledge and skills of state management according to the standards of civil servant ranks, including:

- For civil servants of expert rank and equivalent, the maximum implementation time is 04 weeks;

- For civil servants with the rank of main specialist and equivalent, the maximum implementation time is 06 weeks;

- For civil servants with the rank of senior specialist and equivalent, the maximum implementation time is 08 weeks.

(Previously, Decree 101/2017 stipulating programs and documents for fostering state management knowledge according to the standards of civil servant rank, the minimum implementation time is 06 weeks, the maximum is 08 weeks, for the ranks: officer rank, specialist rank, main expert rank, senior expert rank and the equivalent).

* Training programs and materials according to the standards of professional titles of specialized public employees: Each major has 01 program, the maximum implementation time is 06 weeks.

(Currently, the minimum implementation time is 06 weeks, the maximum is 08 weeks).

* Programs and materials to foster knowledge and skills according to job position requirements

- Training according to the requirements of leadership and management positions, the maximum implementation time is 02 weeks, including:

+ Training programs and documents for leaders, departmental managers and equivalent;

+ Training programs and documents for leaders and managers at district and equivalent levels;

+ Training programs and documents for leaders and managers at departmental and equivalent levels;

+ Training programs and documents for leaders, departmental managers and equivalent.

(Currently, there are regulations on fostering Deputy Ministers and equivalent, the minimum implementation time is 02 weeks, the maximum is 04 weeks).

- Training programs and documents according to requirements of professional and professional positions (specialized professions; shared professional skills; specialized professional titles; shared professional titles): time The maximum duration of each program is 1 week.

- Training programs and materials according to the standards of positions and titles of commune-level cadres and civil servants: the maximum duration of each program is 01 week.

(Currently, the minimum implementation time is 02 weeks, the maximum is 04 weeks).

4. Requirement to participate in training programs

Decree 89/2021 of Vietnam stipulates the requirements to participate in training programs as follows:

- Officials and public employees participate in training programs on political theory, and training programs on defence and security knowledge under the guidance of competent agencies.

- Civil servants must complete a training program on knowledge and skills of state management according to the standards of civil servant rank before being appointed to the rank.

- Public employees must complete a training program according to the professional title standards of specialized public employees before appointing professional titles.

- Officials and public employees participate in training programs on knowledge and skills according to job position requirements according to regulations of agencies competent to manage officials and public employees and according to personal needs, the minimum implementation time is 01 week (40 periods)/year, maximum 04 weeks (160 periods)/year.

This is a new content compared to Decree 101/2017 of Vietnam

5. New regulations on the use of training certificates in Vietnam 

Decree 89/2021 of Vietnam  stipulates the certificate of training program for cadres, civil servants and public employees as follows:

- Ho Chi Minh National Academy of Politics, National Academy of Public Administration; training and retraining establishments; training and research institutions granting certificates of training programs assigned to perform.

- Public employees with practice certificates as prescribed by law may be used instead of certificates of training programs according to the standards of professional titles of corresponding specialized public employees. (New rules)

- Certificate of training program for cadres, civil servants and public employees; commune-level cadres and civil servants used nationwide. The Ministry of Home Affairs provides specific guidance on management, use and certificate templates.

In addition, compared to the current, Decree 89/2021 no longer lists certificates of training programs for civil servants and public employees like Decree 101/2017.

Note: Cadres, civil servants and public employees have certificates of completion of training programs specified in Clauses 3, 4, 5, 6, and 7 Article 17 of Decree 101/2017/ND-CP of Vietnam or Those who have been appointed to positions, ranks of civil servants or professional titles of public employees before June 30, 2022, are not required to participate in corresponding training programs according to the provisions of Decree 89/2021 of Vietnam.
