Content in the Draft Decision stipulating professional and specialized standards, conditions and procedures, record for promotion examination for Verifiers and Court Clerks issued by the Chief Justice of the Supreme People's Court:
Issued according to the Draft Decision of the TANDTC is a Regulation on the professional qualifications, conditions, and procedures for examination dossiers for promotion of Investigators and Court Clerks. Investigators and Court Clerks who meet certain conditions specified in Article 13 of the Draft Decision are eligible to register for the promotion exam. The promotion exam is organized on a competitive basis among Investigators and Clerks of the same People's Court.
In addition, civil servants and other employees in the People's Courts who meet the conditions may also take the exam and be reclassified or promoted to the rank of Investigator or Court Clerk.
Conditions for taking the promotion exam for Investigators and Court Clerks:
Investigators and Court Clerks wishing to take the promotion exam must meet the conditions in Clause 1, Article 13 of the Draft Decision, including:
- "Successfully completing tasks for the last 3 consecutive years; possessing good political and ethical qualities; not currently under disciplinary action or having a notice of disciplinary consideration from a competent authority;
- Having the competence and professional qualifications to undertake a job position corresponding to a higher rank within the same professional branch;
- Meeting the requirements for diplomas, certificates, and other professional, technical standards of the rank being applied for."
In addition to the general conditions, the Draft Decision stipulates that the rank of Court Clerk requires at least a Bachelor's degree, recruitment by various levels of the Court, training in Clerk professional skills, completion of a probationary period, and appointment to the rank of Court Clerk. Civil servants and other employees in the People's Courts must have held the rank of Assistant or equivalent for a minimum of 3 years (36 months). If currently holding the rank of Employee, they must have at least 5 years (60 months) of experience in that or an equivalent rank, and have been trained in Clerk professional skills. (Point a, Clause 2, Article 13).
For the rank of Investigator, the Draft Decision stipulates the official condition for registering for the promotion exam to Investigator: they must be a Court Clerk with at least 5 years (60 months) of service and have been trained in Investigator professional skills to be considered for appointment to the rank of Investigator. (Point a, Clause 3, Article 13). The reclassification from Court Clerk to Investigator is carried out when the official changes job positions or needs to be reclassified to meet the requirements of the new job position. This reclassification must be based on the proposal of the Head of the unit or the competent authority managing the official's reclassification. Note that when reclassifying from Court Clerk to Investigator, it is not combined with promotion or salary increase. (Clause 4, Article 13)
