Clause 3 Article 26 of Circular 58/2020/TT-BCA stipulates that vehicles that have changed ownership through multiple parties but lack or do not have ownership transfer documents will be processed for registration and transfer of ownership according to Article 19 of this Circular until December 31, 2021.

Therefore, according to this Circular, in cases where the transfer of ownership of old motorbikes occurs but the person registering the transfer does not have sales documents, registration and transfer of ownership will still be processed in accordance with Article 19 from August 1, 2020, to the end of December 31, 2021.

To be specific, Article 19 of Circular 58/2020/TT-BCA stipulates the procedures for processing registration and transfer of ownership for vehicles that have changed ownership through multiple parties as follows:

Procedures and documents for transfer of ownership:

The current vehicle user must go to the vehicle registration management authority to complete the transfer of ownership procedures, presenting documents as stipulated in Article 9 of Circular 58/2020/TT-BCA, clearly stating the legal process of buying, selling, and transferring the vehicle, committing to the origin of the vehicle, and submitting the following documents:

- The vehicle registration certificate and license plates in accordance with Clause 3, Article 6 of Circular 58/2020/TT-BCA.- Ownership transfer documents from the registered owner and the final seller (if any).

Procedures and documents for registration of ownership transfer:

The current vehicle user contacts the vehicle registration authority at their residence, presenting documents as stipulated in Article 9 of Circular 58/2020/TT-BCA, and submitting the following documents:

- Vehicle registration declaration form (according to form No. 01);- Proof of payment of registration fee as stipulated;- Certificate of registration cancellation, license plates (in case of different provinces and motorcycles registered at different points).

Responsibility of the vehicle registration authority:

- If the current vehicle user has ownership transfer documents from the registered owner and the final seller: Within two working days from the date of receiving a complete and valid dossier, the vehicle registration management authority must process the registration, issue license plates (for cars transferring ownership within the same province and motorcycles within the same registration point) or issue a Certificate of registration cancellation, license plates for the current vehicle user to complete the registration, and issue license plates at their place of residence;- If the current vehicle user does not have ownership transfer documents: The vehicle registration management authority issues a temporary license valid for 30 days; sends a notification to the person named in the vehicle registration, publicly posts on the electronic information page of the Traffic Police Department and at its headquarters, checks the stolen vehicle archives and vehicle registration data immediately after receiving the ownership transfer dossier.

After 30 days, if there are no disputes or complaints, the vehicle registration management authority must process the registration, issue license plates (for cars transferring ownership within the same province and motorcycles within the same registration point) or issue a Certificate of registration cancellation, license plates for the current vehicle user to complete the registration and issue license plates at their place of residence.

Responsibility of the current vehicle user:

- Directly go to the vehicle registration authority to complete the transfer of ownership procedures;- Declare and commit to take responsibility before the law for the origin of the vehicle, the buying, selling, and transferring process;- Declare and pay the registration fee as stipulated by law.

Previously, Article 24 of Circular 15/2014/TT-BCA also allowed two-wheeled motorcycles, three-wheeled motorcycles, mopeds (including electric bikes), and similar types of vehicles that had changed ownership through multiple parties to be registered for ownership transfer according to Article 24 of this Circular from January 1, 2015, to the end of December 31, 2016. After 2016, the registration of ownership transfer required the person registering to have ownership transfer documents to complete the transfer procedures. And from August 1, 2020, according to Circular 58/2020/TT-BCA, citizens will continue to be able to register the transfer of ownership of motorbikes that had changed ownership through multiple parties without sales documents until the end of December 31, 2021.
