Will the licenses to practice groundwater drilling be revoked if financial obligations are not fulfilled in Vietnam?
Clause 2, Article 10 of Circular 40/2014/TT-BTNMT stipulates the revocation of licenses as follows:
- The revocation of licenses shall be carried out in the following cases:
a) The license holder is found to have forged documents, provided untruthful declarations in the application dossier for the license, or made alterations that falsify the content of the license;
b) The organization holding the license is dissolved or declared bankrupt by a court;
c) The license holder violates the decision to suspend the validity of the license, recidivates or repeatedly violates the provisions of the license;
d) The license was issued without proper authority;
dd) The license was issued but the license holder does not fulfill financial obligations and does not receive the license.
Thus, in the case where you do not fulfill financial obligations to the state agency, your licenses to practice groundwater drilling will be revoked.
Authority to revoke large-scale groundwater drilling licenses in Vietnam
Clause 1, Article 11 of Circular 40/2014/TT-BTNMT stipulates as follows:
Article 11. Authority to issue, extend, adjust the content, reissue, suspend validity, revoke groundwater drilling licenses
- The Ministry of Natural Resources and Environment shall issue, extend, adjust the content, reissue, suspend the validity, and revoke large-scale groundwater drilling licenses as regulated at Point c Clause 1 Article 5 of this Circular.
Point c, Clause 1, Article 5 of Circular 40/2014/TT-BTNMT stipulates as follows:
Article 5. Scale of groundwater drilling practice
- The scale of groundwater drilling practice is stipulated as follows:
c) Large-scale groundwater drilling practice includes cases not regulated at Points a and b, Clause 1 of this Article.
Thus, the Ministry of Natural Resources and Environment will have the authority to revoke large-scale groundwater drilling licenses.
