On May 16, 2024, the Minister of Natural Resources and Environment issued Circular 03/2024/TT-BTNMT detailing the implementation of certain provisions of the Law on Water Resources.
Article 9 of Circular 03/2024/TT-BTNMT stipulates that two water extraction projects supplying domestic water for production, business, and service establishments must identify and publicly announce the sanitary protection zones for the domestic water intake area, including:
- Surface water extraction projects with a scale of over 100 m³/day-night.
- Groundwater extraction projects with a scale of over 10 m³/day-night.

What are the principles for determining the sanitary protection zones around domestic water intake areas?
Article 8 of Circular 03/2024/TT-BTNMT specifies the principles for determining the sanitary protection zones around domestic water intake areas:
- Ensure the prevention and minimization of negative impacts on the water quality of the water extraction projects supplying domestic water and other functions of the water source.- Suitable to the terrain, geological, hydrogeological conditions, flow policies, water source characteristics, extraction scale, layout diagram of the project, and other related features for protecting the domestic water source quality.- Consistent with the current land use status and the socio-economic development activities of the area with water extraction projects for domestic supply.
How are the sanitary protection zone limits for surface water extraction projects from reservoirs, dams regulated?
Article 10 of Circular 03/2024/TT-BTNMT specifies the sanitary protection zone limits for surface water extraction projects as follows:
Sanitary protection zone limits for surface water extraction projects
- The sanitary protection zone limits for surface water extraction projects on rivers, streams, canals, and ditches for domestic supply are the upstream and downstream areas from the water extraction location of the project (including the water source protection corridor limits that the project extracts), regulated as follows:
a) For extraction projects with a scale of over 100 m³/day-night to less than 50,000 m³/day-night, the sanitary protection zone should not be less than 1,000 m upstream and not less than 100 m downstream in mountainous areas; not less than 800 m upstream and not less than 200 m downstream in delta and midland areas;
b) For extraction projects with a scale from 50,000 m³/day-night or more, the sanitary protection zone should not be less than 1,500 m upstream and not less than 100 m downstream in mountainous areas; not less than 1,000 m upstream and not less than 200 m downstream in delta and midland areas.
- The sanitary protection zone limits for surface water extraction projects from reservoirs and dams for domestic supply are determined from the water extraction location of the project, regulated as follows:
a) Not less than 1,500 m from the water extraction location for extraction projects from reservoirs and dams on rivers and streams, and should not exceed the water source protection corridor limits of the reservoir, dam protection range;
b) The entire lake area for extraction projects from reservoirs not covered in point a of this section.
Thus, the sanitary protection zone limits for surface water extraction projects from reservoirs and dams are regulated as follows:
- Not less than 1,500 m from the water extraction location for extraction projects from reservoirs and dams on rivers and streams, and should not exceed the water source protection corridor limits of the reservoir, dam protection range;
- The entire lake area for extraction projects from reservoirs not covered in (1).
