New Circular Officially Regulates Revisions to Rescue and Firefighting by Fire Prevention and Fighting Forces?

On July 10, 2024, the Minister of Public Security issued Circular 32/2024/TT-BCA amending Circular 149/2020/TT-BCA guiding the Law on Fire Prevention and Fighting and the amended Law on Fire Prevention and Fighting and Decree 136/2020/ND-CP guiding the Law on Fire Prevention and Fighting and the amended Law on Fire Prevention and Fighting, and Circular 08/2018/TT-BCA guiding Decree 83/2017/ND-CP which stipulates the rescue and firefighting work of the fire prevention and fighting forces.

Circular 32/2024/TT-BCA has amended several contents such as:

- Management and monitoring of fire prevention and firefighting activities- Duration for practicing firefighting plans- Establishment of specialized fire prevention and firefighting teams- Inspection stamps for fire prevention and firefighting equipment...and some other important contents.

Circular 32/2024/TT-BCA takes effect from August 24, 2024.

Management and Monitoring Files of Fire Prevention and Fighting Activities Under the Latest 2024 Regulations

Based on Article 4 of Circular 149/2020/TT-BCA as amended and supplemented by Clause 1 Article 1 of Circular 32/2024/TT-BCA, the management and monitoring files of fire prevention and fighting activities are specified as follows:

The management and monitoring files of fire prevention and fighting activities at establishments listed in Appendix 3 issued with Decree 50/2024/ND-CP are created and stored by the head of the establishment, including:

- Decisions promulgating internal regulations, directives, and guides on fire prevention and fighting; decisions assigning responsibilities for performing fire prevention and fighting tasks at the establishment (if any);- Certificates of design appraisal, documents on design appraisal for fire prevention and fighting, documents approving acceptance results for fire prevention and fighting that have been issued;- Copies of site plans showing traffic routes, water sources for firefighting, and functional layouts of items, and technological processes at the establishment that have been approved by competent authorities (if any);- Decisions on the establishment of internal fire prevention and fighting teams, specialized fire prevention and fighting teams as required by regulations;- Certification of professional training on fire, rescue, and firefighting issued by the competent Public Security authority;- Firefighting plans approved by competent authorities; plans and reports on the results of fire drill exercises at the establishment;- Inspection records on fire, rescue, and firefighting by competent authorities as specified in Point d Clause 3 Article 16 of Decree 136/2020/ND-CP and Point b Clause 8 Article 1 of Decree 50/2024/ND-CP;- Fire prevention and fighting recommendations;- Record of violations, decisions on administrative penalties for violations regarding fire, rescue, and firefighting; temporary suspension decisions, suspension decisions, and restoration of operation decisions by competent authorities (if any);- Reports on changes in fire prevention and safety conditions at the establishment;- Periodic semi-annual inspection reports on fire prevention and fighting by the head of the establishment listed in Appendix 3 issued with Decree 50/2024/ND-CP;- Incident, accident, and explosion reports (if any); official announcements on investigation and incident resolution results by competent authorities (if any);- Certificates of eligibility for fire prevention and firefighting service operation for establishments providing fire prevention and firefighting services;- Certificates of compulsory fire and explosion insurance for establishments with a high risk of fire and explosion listed in Appendix 2 issued with Decree 67/2023/ND-CP;- Documents recording the results of grounding resistance tests, inspections of systems, equipment, and pressure pipelines as per regulations (if any).

How is the Inspection of Safety Conditions for Rescue and Firefighting Work by Public Security Carried Out?

Based on Article 6 of Circular 08/2018/TT-BCA as amended and supplemented by Clause 1 Article 2 of Circular 32/2024/TT-BCA, the inspection of safety conditions for rescue and firefighting work by Public Security is stipulated as follows:

Inspection of Safety Conditions for Rescue and Firefighting by Fire Prevention, Fighting, and Rescue Police

  1. The Public Security authority conducts inspections of safety conditions for rescue and firefighting as specified in Clause 3 Article 2 of Decree 50/2024/ND-CP.

  2. Inspections of safety conditions for rescue and firefighting at establishments are combined with fire prevention and firefighting inspections.

Thus, the Public Security authority conducts periodic or sudden inspections of safety conditions for fire, explosions, incidents, emergencies, and the conditions, measures, and firefighting plans within the scope of the establishment according to its scale, nature, and characteristics.
