The maximum contract term for rubber tree plantations is how many years? What is the maximum land allocation for rubber tree plantations for households?To the Editorial Board,My household is planning to contract state land for a rubber tree plantation for business production, but we do not know the maximum term that can be contracted currently and the maximum allowable contract area. We kindly ask the Editorial Board for guidance.

What is the maximum duration for contracting rubber tree plantations?

Pursuant to Clause 1 Article 6 of Decree 168/2016/ND-CP regulating the duration of contracts as follows:

  1. Contract duration

a) Duration for contracted work, services: As agreed upon between the contracting party and the contract receiver, but no more than 01 year and within the period the contracting party is allocated land or leased agricultural land by the state.

b) Stable contract duration: According to the crop cycle, livestock cycle, business production cycle, or as agreed upon between the contracting party and the contract receiver, but no more than 20 years and within the period the contracting party is allocated land or leased agricultural land by the state.

In case the contract expires, if the contract receiver does not violate the contract, meets the criteria stipulated in Article 4 of this Decree, and wishes to continue receiving the contract, the contract can be renewed.

Therefore, your family can receive a rubber tree plantation contract with a stable contract duration according to the crop cycle, business production cycle, or as agreed upon between the contracting party and the contract receiver, but no more than 20 years.

What is the maximum area for a rubber tree plantation contract for households?

According to Clause 2 Article 6 of Decree 168/2016/ND-CP regulating the contract limit as follows:

  1. Contract limit

For contracted work, services, the contract limit is agreed upon by the contracting party and the contract receiver. In the case of a stable contract according to the business production cycle, the contracting party bases the contract area and the needs of the contract receiver to agree and determine an appropriate contract limit, wherein:

a) The contract limit for individuals is as agreed upon, but no more than 15 hectares.

b) The contract limit for households is as agreed upon, but no more than 30 hectares.

c) The contract limit for village communities is as agreed upon, but the total contracted area must not exceed the average area per household in the community, capped at no more than 30 hectares at the time of the contract.

Therefore, when your family accepts a contract, the agreed contract limit should not exceed 30 hectares.
