Conversion from annual crop land to livestock facility construction: Is a permit required?
Clause 1 Article 12 of Circular 33/2017/TT-BTNMT (amending Clause 1 Article 11 of Circular 02/2015/TT-BTNMT) stipulates cases of land use purpose change that do not require permission from the competent state agency but require registration of changes, including:
Changing annual crop land to other agricultural land, including: land used for the construction of greenhouses and other types of structures for cultivation purposes; land used for livestock, poultry, and other animal farming as permitted by law; aquaculture for educational, research, and experimental purposes.
Thus, when converting annual crop land to land for the construction of livestock, poultry farms, it does not require permission but requires registration of changes.
- The dossier for registration of changes is prescribed in Clause 2 Article 11 of Circular 02/2015/TT-BTNMT, including:
+ Application for registration of land changes, and assets attached to land according to Form No. 09/DK issued together with Circular 24/2014/TT-BTNMT;
+ Land use rights certificate; Land use rights, house ownership, and other assets attached to land certificate; House ownership and homestead land use rights certificate (hereinafter collectively referred to as the Certificate).
- Land users shall submit the dossier at the commune-level People’s Committee where the land is located or the Land Registration Office or at the reception and result return department of the Department of Natural Resources and Environment.
- The Land Registration Office is responsible for checking the dossier; verifying the actual situation if necessary; confirming in the Application for registration; certifying the land use purpose in the Certificate; adjusting and updating changes in cadastral records, land database (if any); handing over the Certificate to the grantee or sending it to the commune-level People’s Committee for delivery in case the dossier is submitted at the commune level.
