Resolution 18-NQ-TW: By 2023, the land law must be completed in Vietnam

The Central Executive Committee of Vietnam has just promulgated Resolution No. 18-NQ/TW of the 5th Conference of the Party Central Committee, term XIII on "Continuing to renovate and perfect institutions and policies, improve effectiveness and efficiency. management and use of land, creating a driving force to turn our country into a high-income developed country."

Accordingly, the Central Executive Committee of Vietnam has clearly stated its views and set goals for each period to 2030 as follows:

 I. Point of view

1. Land owned by the entire people:

Land belongs to the entire people, and the State is the representative of the owner and uniformly manages it. The State exercises the rights of the owner through the decision on master plans and plans on land use; land recovery, land allocation, land lease, recognition of land use rights, permission to change the use purpose and stipulation of land use term; decide on land prices; policy decisions to regulate the value added from land that is not created by land users. The State recovers land to use for defense and security purposes; socio-economic development for the national and public interests in accordance with the law, ensuring fairness, publicity and transparency, and upholding accountability. Land management and use must ensure the common interests of the entire people; People are given favorable conditions to access and use land fairly, openly, effectively and sustainably.

The State uniformly manages land according to the national territory, both in terms of area, quality, economic, cultural, social, national defense, security and environmental values; reasonable assignment of state agencies at the central level, and at the same time, have appropriate and effective decentralization and decentralization of powers for localities and strengthen control, supervision, control and handling of violations.

2. Land use rights that are not ownership rights:

Land use rights are a special type of property and goods but not an ownership right; land use rights and land-attached assets are protected by law. Land users have the rights and obligations to use land in accordance with law. The State does not recognize the reclaiming of land that has been allocated by the State to others for use in the course of implementing policies and laws on land; do not adjust agricultural land allocated to households and individuals; promptly adopt appropriate policies so that agricultural land can be exploited and used with the highest efficiency.

3. Institutions and policies on land must be compatible with the institutions for the development of the socialist economy

Institutions and policies on land must be completed synchronously and in line with the institution of developing a socialist-oriented market economy. To adopt policies suitable to each object and type of land use to arouse potentials and maximize the value of land resources; resolutely overcome corruption, negativity, complaints about land, speculation and wasteful land use.

4. Improve the effectiveness and efficiency of state management of land.

Modernizing land management and public services. Consolidating and perfecting the organizational system of land management apparatus which is streamlined, effective, efficient, centralized, synchronous and unified. Improve the role and capacity of judicial agencies in settling complaints, denunciations and disputes over land. Land must be fully investigated, assessed, statistic, inventoried, quantified and accounted for in the economy; be planned for efficient and rational use with a long-term vision, harmonizing interests between generations, regions and regions, between socio-economic development and assurance of national defense and security; development of education, culture and sports; environmental protection and adaptation to climate change; ensure national food security. Solve well the inadequacies and obstacles in land management and use left by history and new requirements of practice.

5. Strengthen the leadership of the Party, bring into play the role of the Vietnam Fatherland Front, socio-political organizations and people in formulating, implementing and supervising the implementation of policies and laws about land.

II. Target

1. Overall goal

To perfect institutions and policies on land management and use in a synchronous manner and in line with the institution of developing a socialist-oriented market economy. Land resources are managed, exploited and used in the most economical, sustainable and efficient manner; meet the requirements of promoting industrialization, modernization, equity and social stability; ensuring national defense and security; environmental protection; adaptation to climate change; creating a driving force for our country to become a high-income developed country. The real estate market, including the land use right market, has become a rational, fair and efficient land allocation channel.

2. Specific goals

By 2025:

By 2023, amendments to the 2013 Land Law and a number of related laws must be completed, ensuring uniformity and consistency in Vietnam. To basically solve the shortcomings and problems related to the management and use of land originating from state-owned agricultural and forestry farms; land for national defense and security in combination with production and economic construction; land of production establishments and non-business units that have been relocated from the centers of large urban centers; encroaching land; religious land; cemetery land; land combined with multiple uses; residential land, production land for ethnic minorities.

By 2030:

The legal system on land has basically been completed synchronously and consistently, in line with the institution of developing a socialist-oriented market economy. Overcome the state of wasteful land use, land fallow, pollution, degradation, and problems in land management and use left by history.
