What are assets subject to auction in Vietnam?

According to Article 4 of the Law on Property Auction 2016 (amended by Clause 2, Article 1 of the Amended Property Auction Law 2024), the assets to be auctioned include:

(1) Assets required by law to be auctioned, including:

- Land use rights under the provisions of the law on land;

- Mineral exploitation rights under the provisions of the law on minerals;

- Rights to use radio frequencies under the provisions of the law on radio frequencies;

- Rights to use telecommunications codes, numbers, and the Vietnamese national domain name ".vn" under the provisions of the law on telecommunications;

- Rights to use forests, forest leasing under the provisions of the law on forestry;

- Fixed assets of enterprises under the provisions of the law on management and use of state capital invested in production and business at enterprises;

- Assets that are national reserves under the provisions of the law on national reserves;

- Public assets in agencies, organizations, units, infrastructure assets, assets acquired as state ownership, assets of state-funded projects under the provisions of the law on the management and use of public assets;

- Assets for enforcement of civil judgments under the provisions of the law on civil judgment enforcement;

- Secured assets under the provisions of the law on ensuring the performance of obligations;

- Assets seized to ensure the enforcement of administrative penalties under the provisions of the law on handling administrative violations;

- Assets of cooperatives, unions of cooperatives in bankruptcy according to the law on cooperatives and bankruptcy law;

- Assets of enterprises in bankruptcy under the provisions of the bankruptcy law;

- Non-performing loans and secured assets of non-performing loans of organizations owned 100% by the state capital, established by the State Bank of Vietnam to handle non-performing loans of credit institutions under the provisions of law;

- Other assets required by law to be auctioned.

(2) Assets not included in the above provisions that individuals or organizations voluntarily choose to auction.
