What is the organizational structure of the Ministry of Health of Vietnam from March 1, 2025? What are responsibilities and authorities of the Ministry of Health of Vietnam?

On February 27, 2025, the Government of Vietnam issued Decree 42/2025/ND-CP stipulating the functions, duties, powers, and organizational structure of the Ministry of Health.

The Ministry of Health is an agency of the Government of Vietnam, performing the state management function over fields including: Preventive health; examination, treatment, and rehabilitation; medical, forensic, and psychiatric assessments; mother and child care; population; prevention and fight against social evils (excluding drug addiction treatment and post-treatment management); social protection; traditional medicine and pharmacy; pharmaceuticals, cosmetics; food safety; medical equipment; health insurance, and state management of public services within the scope of state management of the Ministry of Health.

Additionally, according to Article 3 of Decree 42/2025/ND-CP, the organizational structure of the Ministry of Health from March 1, 2025, is as follows:

(1) Department of Health Insurance.

(2) Department of Personnel Organization.

(3) Department of Planning - Finance.

(4) Department of Legal Affairs.

(5) Department of International Cooperation.

(6) Office of the Ministry.

(7) Inspectorate of the Ministry.

(8) Administration of Medical Services.

(9) Administration of Traditional Medicine and Pharmacy.

(10) Drug Administration.

(11) Food Safety Administration.

(12) Administration of Infrastructure and Medical Equipment.

(13) Administration of Science and Technology and Training.

(14) General Office for Population.

(15) Administration of Disease Prevention.

(16) Administration for Maternal and Child Health.

(17) Department of Social Protection.

(18) Institute of Health Strategy and Policy.

(19) National Health Information Center.

(20) Health and Life Newspaper.

The organizations from (1) to (17) are assisting organizations to the Minister in performing the state management function; the organizations from (18) to (20) are public service providers serving the state management function of the Ministry of Health.

The Department of Planning - Finance has 5 divisions.

The Minister of Health submits to the Prime Minister of the Government of Vietnam the issuance of a list of other public service providers under the Ministry of Health in accordance with regulations.

The Minister of Health issues decisions defining the functions, duties, powers, and organizational structure of the organizations and units under the Ministry of Health.

What are the duties and powers of the Ministry of Health of Vietnam from March 1, 2025?

According to Article 2 of Decree 42/2025/ND-CP regarding the duties and powers of the Ministry of Health of Vietnam:

The Ministry of Health performs the duties and powers as prescribed by the Law on the Organization of the Government, regulations of the Government of Vietnam on the functions, duties, powers, and organizational structures of ministries and ministerial-level agencies. Notably, the Ministry of Health of Vietnam performs specific responsibilities and powers regarding medical equipment and healthcare facilities as follows:

- Develop, issue, or submit to competent authorities for issuance national standards, national technical regulations, strategies, policies, and plans on medical equipment;

- Issue detailed guidance on standards, norms for the use of machinery, specialized equipment serving health career activities; issue a list of medical equipment subject to verification and verification procedures for each type of equipment in the list;

- Grant, suspend, and revoke registration numbers for circulation of medical equipment; grant, revoke free sale certificates for medical equipment; issue and publicize documents on the revocation of results of the classification of medical equipment; issue import licenses for medical equipment; publicize information and dossiers of announced inputs for the production of medical equipment and external control substances containing narcotics and precursors; publicize the list of medical equipment that have had their registration numbers revoked;

- Grant new, replace, supplement, revoke certificates of registration for equipment verification activities within the management assignment according to legal regulations; publicize information and dossiers for conditions to perform medical equipment technical consulting services;

- Preside over, cooperate with relevant agencies to direct, guide, organize the implementation of legal documents, national standards, national technical regulations in the medical equipment field;

- Preside over, cooperate with relevant agencies to develop, issue technical regulations and specific regulations on standards, usage norms for constructions belonging to the healthcare facilities as per law and assigned authority.
