Vietnam: Which duties must classroom teachers fulfill?

What are the responsibilities of homeroom teachers? How is the annual working time allocated for teachers at all levels?

What duties must a homeroom teacher fulfill?

According to the regulations in Article 4 of Circular 28/2009/TT-BGDDT of the Ministry of Education and Training of Vietnam, a homeroom teacher must fulfill the following duties:

- Understand and grasp the overall situation of the students in the class in order to develop suitable educational measures to promote the progress of each student and the entire class;

- Collaborate closely with the students’ families, proactively cooperate with subject teachers, the Ho Chi Minh Communist Youth Union, the Ho Chi Minh Young Pioneers Organization, and other related social organizations in teaching and educating the students in the class they are in charge of;

- Evaluate and classify students at the end of each term and school year, recommend rewards and disciplinary actions for students, propose the list of students for promotion, those who need to retake exams, those who need to improve their conduct during the summer break, those who need to repeat the class, and complete the recording of scores and students' academic records;

- Participate in guiding collective activities, educational activities, and training for students organized by the school;

- Report regularly or unexpectedly on the situation of the class to the Principal.

Additionally, a homeroom teacher must perform the duties as specified in Article 3 of Circular 28/2009/TT-BGDDT, amended by Clause 2, Article 1 of Circular 15/2017/TT-BGDDT, which specifies:

- Homeroom teachers must perform the duties as stipulated in the charter of primary schools, charter of secondary schools, high schools, and multi-level schools;

- Homeroom teachers must comply with the regulations on the organization and operation of ethnic boarding, semi-boarding schools, specialized schools, and pre-university schools.

What is the working schedule for primary, middle, and high school teachers during the school year?

According to the regulations in Article 5 of Circular 28/2009/TT-BGDDT, supplemented by Clause 3, Article 1 of Circular 15/2017/TT-BGDDT, the working schedule for primary, middle, and high school teachers during the school year is as follows:

(1) For primary school teachers

The working period during the school year is 42 weeks, including:

- 35 weeks for teaching and educational activities as per the school year's schedule.

- 05 weeks for learning and professional development.

- 01 week for preparing for the new school year.

- 01 week for summarizing the school year.

(2) For middle and high school teachers:

The working period for middle and high school teachers during the school year is 42 weeks, including:

- The working period for pre-university school teachers is 42 weeks, including:

+ 28 weeks for teaching and educational activities as per the school year's schedule;

+ 12 weeks for learning, professional development, material development, scientific research, and other activities planned for the school year;

+ 01 week for preparing for the new school year;

+ 01 week for summarizing the school year.

- 03 weeks for learning and professional development.

What are the working periods of teachers that are not eligible for seniority allowance?

Based on Article 3 of Decree 77/2021/ND-CP of Vietnam's Government, the provisions are as follows:

Periods eligible for and non-eligible for seniority allowance

1. Periods eligible for seniority allowance

The periods eligible for seniority allowance include the following accumulated periods:

a) Periods of teaching and education with mandatory social insurance in public educational institutions.

b) Periods of teaching and education with mandatory social insurance in non-public educational institutions (for educators currently teaching in public institutions who have previously taught in non-public institutions).

c) Periods of work eligible for seniority allowance, including: periods working in ranks or titles in the customs, courts, procuracy, audit, inspection, civil judgment enforcement, forest protection, national reserve, party inspection; periods eligible for seniority allowance in the military, police, cipher, and periods of work eligible for seniority allowance in other occupations (if any).

d) Periods of military service if the individual was eligible for occupational seniority allowance before serving.

2. Periods not eligible for seniority allowance

a) Probation periods.

b) Periods of unpaid leave continuously for 01 month or more.

c) Periods of sick leave, maternity leave exceeding the required period as per social insurance regulations.

d) Periods working as experts, studying, interning, working, or surveying domestically or abroad exceeding the approved period.

e) Periods being suspended from work or detained for investigation, prosecution, trial.

f) Other non-working periods not specified in points a, b, c, d, e of clause 2 of this Article.

Thus, the working periods of teachers not eligible for seniority allowance include the following periods:

- Probation periods.

- Periods of unpaid leave continuously for 01 month or more.

- Periods of sick leave, maternity leave exceeding the required period as per the regulations.

- Periods working as experts, studying, interning, working, or surveying domestically or abroad exceeding the approved period.

- Periods being suspended from work or detained for investigation, prosecution, trial.

- Other non-working periods as specified above.
