What are the public holidays on which teachers in Vietnam are entitled to fully paid days off?

According to Article 112 of the Labor Code 2019 on public holidays:

Public holidays

1. Employees shall be entitled to fully paid days off on the following public holidays:

a) Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);

b) Lunar New Year Holidays: 05 days;

c) Victory Day: 01 day (the 30th of April of the Gregorian calendar);

d) International Labor Day: 01 day (the 1st of May of the Gregorian calendar);

dd) National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);

e) Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).

2. Foreign employees in Vietnam are entitled to 01 traditional public holiday and 01 National Day of their country, in addition to the public holidays stipulated in Clause 1 of this Article.

3. The Prime Minister shall decide the specific public holidays mentioned in Point b and Point dd Clause 1 of this Article on an annual basis.

Thus, teachers in Vietnam are entitled to fully paid days off on the following public holidays:

- Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);

- Lunar New Year Holidays: 05 days;

- Victory Day: 01 day (the 30th of April of the Gregorian calendar);

- International Labor Day: 01 day (the 1st of May of the Gregorian calendar);

- National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);

- Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).

However, if teachers want to take time off on other days, they may apply for:

(1) Annual leave

According to Article 114 of the Labor Code 2019, employees are entitled to 12 to 16 days of annual leave if they work a full year. Thus, if an employee still has leave or can take advance leave, they can use these days to request time off.

(2) Accumulated Leave

Under Clause 4, Article 113 of the Labor Code 2019, an employee may reach an agreement with the employer on taking annual leave in installments or combining annual leave over a maximum period of up to 03 years.

In cases where the school approves the accumulated leave, teachers will be entitled to full pay for these additional days off.

(3) Unpaid leave

Teachers can negotiate with their superiors or their school for unpaid leave if they have exhausted their annual leave or wish to conserve leave days.

Note: Taking additional days off by accumulating leave or taking unpaid leave must be agreed upon and approved by the superior or the workplace; unauthorized absence is considered as abandoning work.

What are the standardized educational qualifications of teachers in Vietnam?

According to Article 72 of the Education Law 2019, the standardized educational qualifications of teachers in Vietnam are regulated as follows:

- Teachers of preschool education teachers must possess at least a pedagogical college diploma;

- Teachers of primary education, lower secondary education and upper secondary education must possess at least a bachelor’s degree in pedagogy training.

In case a subject is yet to acquire enough teachers with bachelor’s degree in pedagogy training, teachers of this subject must possess a bachelor's degree of suitable specialization and a certificate of pedagogy training;

- Lecturers of higher education must possess a master’s degree; lecturers teaching or instructing master or doctor’s theses must possess a doctoral degree.

- Standardized educational qualifications of teachers working in institutions of vocational education shall follow regulations in the Law on Vocational education.

What are the regulations for the education and training for teachers in Vietnam?

According to Article 73 of the Education Law 2019, the education and training for teachers in Vietnam are regulated as follows:

- The State shall elaborate policies for educating and upgrading teachers in terms of political qualification, professional qualification and knowledge; Teachers nominated to attend educating and upgrading training shall receive salary and subsidies as regulated by the Government.

- Educational institutions shall be responsible for enabling teachers to receive education and training to acquire necessary qualifications as prescribed by law.
