How many weeks of summer vacation do teachers at private higher education institutions in Vietnam have?
According to Point c, Clause 1, Article 3 of Decree 84/2020/ND-CP, the summer vacation of teachers in Vietnam is stipulated as follows:
Summer vacation of teachers
1. Summer vacation of teachers:
a) Annual summer vacation of teachers of institutions for preschool education, institutions for general education, and special schools is 8 weeks, including annual permitted leave;
b) Annual summer vacation of teachers of vocational secondary schools and colleges is 6 weeks, including annual permitted leave;
c) Annual summer vacation of teachers of institutions of higher education shall comply with organizational and operational regulations of the institutions of higher education;
d) In case of any irregularity, emergency cases for prevention of natural disasters, diseases or other emergencies, summer vacation of teachers of institutions for preschool education, institutions for general education, special schools, vocational secondary schools and colleges shall be decided by Minister of Education and Training and Minister of Labor – War Invalids and Social Affairs depending on entitlement.
Thus, according to the above regulations, the annual summer vacation for lecturers at higher education institutions (including private institutions) shall comply with the organizational and operational regulations of the higher education institution.

Who has the authority to issue the decision on approval of the establishment of a private higher education institution in Vietnam?
According to Clause 1, Article 88 of Decree 46/2017/ND-CP, procedures for establishment of a public higher education institution, or approval of establishment of a private higher education institution in Vietnam are stipulated as follows:

1. The Prime Minister shall have authority to issue the decision on establishment of a public higher education institution, or approval of establishment of a private higher education institution.
2. A higher education institution shall be established by taking two following steps:
a) Approve the policy on establishment or approval of establishment of the requesting institution;
b) Issue the decision on establishment or approval of establishment of the requesting institution.

Thus, the Prime Minister of Vietnam has the authority to issue the decision on approval of the establishment of a private higher education institution.
What are the procedures for approval of the establishment of a private higher education institution in Vietnam?
According to Clause 6, Article 88 of Decree 46/2017/ND-CP, the procedures for approval of the establishment of a private higher education institution in Vietnam are as follows:
Step 1: Submit the application
The scheme owner submits directly or via postal service one set of the application application to the Ministry of Education and Training.
The application includes:
- The Prime Minister’s written document on approval of the policy on establishment or the policy on permission for establishment of the requesting higher education institution;
-The certified duplicate copy of the investment certificate in case of establishment of a non-public higher education institution, issued by the provincial-level People’s Committee;
- The legally valid document stating confirmation of the land use right or the one issued by the regulatory authority having power to allocate or lease land for a period of 50 years or more for the purpose of construction of the requesting institution with the following issues specified such as location, boundary line, address and area of the land plot where the requesting institution is based;
- The construction planning of the requesting institution and general floor plan approved by the host entity in case of establishment of a public higher education institution, or by the provincial-level People's Committee in case of establishment of a non-public higher education institution;
- The written document containing the detailed report on the progress of execution of the scheme for establishment of the requesting institution, prepared by the host entity (in case of establishment of a public higher education institution) or by the scheme Management Unit together with the opinion received from the People’s Committee of the province where the requesting institution will be based (in case of establishment of a non-public higher education institution);
- The statement of proposed fields or disciplines of study, administrative officers and training scale;
- The legally valid documents indicating confirmation of the investor’s capital put under management of the scheme Management Unit
Step 2: Review, amend, supplement, and appraise the application
Within 15 working days from the date of receiving the application, if the application is incomplete according to regulations, the Minister of Education and Training must notify the scheme owner in writing to amend or supplement it;
For applications that are complete according to regulations, within 60 working days, the Ministry of Education and Training is responsible for coordinating with related agencies to organize the appraisal of the application and the practical appraisal to accurately assess the conditions and content of the proposal, finalize the application and send it to the Ministry of Planning and Investment, Ministry of Finance, Ministry of Home Affairs for written opinions for proposals that meet the conditions according to regulations, and notify the scheme owner in writing for proposals that do not meet the conditions.
The practical appraisal of the proposal is conducted by an appraisal council comprising representatives from the Ministry of Education and Training, Ministry of Planning and Investment, Ministry of Home Affairs, Ministry of Finance, and the provincial People's Committee where the main campus is located.
The appraisal council is established by decision of the Minister of Education and Training and is tasked with advising the Minister of Education and Training on the feasibility of the proposal to submit to the Prime Minister of Vietnam for consideration and decision;
Step 3: Complete the scheme dossier and submit it to the Prime Minister of Vietnam for a decision
Within 30 working days from the date of receiving complete written feedback from related agencies and units, the Ministry of Education and Training consolidates the feedback, completes the scheme dossier, and submits it to the Prime Minister of Vietnam.
