What are details of the Cultural Heritage Law 2024?

On November 23, 2024, the National Assembly of Vietnam passed the Culture Heritage Law 2024 Download, which will replace the Culture Heritage Law 2001.

Specifically, Article 1 of the Culture Heritage Law 2024 Download specifies the scope of adjustment as follows:

- This Law regulates culture heritage, the activities of managing, protecting, and promoting the value of culture heritage; the rights, obligations, and responsibilities of agencies, organizations, communities, and individuals in the activities of managing, protecting, and promoting the value of cultural heritage of the Socialist Republic of Vietnam.

- The culture heritage stipulated in this Law includes intangible cultural heritage and tangible cultural heritage transmitted from generation to generation of the Socialist Republic of Vietnam.

Meanwhile, Article 2 of the Culture Heritage Law 2024 Download specifies the subjects to which this Law applies as follows:

- The Culture Heritage Law 2024 applies to agencies, organizations, communities, and Vietnamese people residing in Vietnam; agencies, organizations, communities, and foreigners residing and operating in Vietnam; Vietnamese citizens residing and operating abroad related to the management, protection, and promotion of cultural heritage values.

What are regulations on educational activities of museums in Vietnam?

Regarding the Regulations on Educational Activities of Museums, it will be clearly stipulated in the Culture Heritage Law 2024 Download as follows:

- Guide tours; organize experiential activities;

- Organize educational programs;

- Organize scientific workshops, seminars, spotlight talks.

Educational activities must be suitable to the content, subject, and scope of museum operations; the learning and cultural enjoyment needs of the public.

How to propagate, advertise, and educate tradition through culture heritage in Vietnam?

According to Article 86 of the Culture Heritage Law 2024 Download:

Propagating, advertising, traditional education through cultural heritage and promoting the value of cultural heritage in the electronic environment

- Propagate, advertise, and educate tradition through cultural heritage via mass media; through displays, introductions, scientific conferences, seminars, creative contests, exhibitions on cultural heritage; festivals, performances of intangible cultural heritage; activities to explore, visit, study cultural heritage linked with educational programs and activities in educational institutions; compile and publish specialized materials on cultural heritage and other appropriate forms as prescribed by law.

- Promoting the value of cultural heritage in the electronic environment carried out according to the provisions of this Law, the law on information technology, electronic transactions, other relevant laws, and must meet the following requirements:

+ Ensure absolute safety for cultural heritage during the process of digital data construction on cultural heritage and digital exhibition content;

+ The collection, storage, processing of data, and use of digital databases by organizations and individuals must comply with the law on copyright and personal data protection;

+ Digital data must comply with standards, technical regulations on digital data, information security, and cybersecurity laws.

In addition, private investment in the protection and promotion of cultural heritage values is regulated in Article 87 of the Culture Heritage Law 2024 Download as follows:

- Encourage and facilitate organizations and individuals to participate in the protection and promotion of cultural heritage values.

- The resource of private investment is used for the following activities:

+ Research, collect, inventory, document, compile scientific dossiers for recognition, ranking, registration of cultural heritage;

+ Research and apply science, technology in activities of protecting and promoting cultural heritage values;

+ Build databases on cultural heritage;

+ Propagate, advertise cultural heritage domestically and internationally;

+ Organize the restoration, practice, teaching, introduction, advertisement, performance, and festival of intangible cultural heritage;

+ Preserve, restore, rehabilitate and promote the value of relics;

+ Probe, excavate archaeology;

+ Research, collect, preserve, digitize, store, restore, and promote the value of documentary heritage;

+ Research, collect, evaluate, inventory, preserve, restore, display, educate, and communicate in museums;

+ Other activities as prescribed by law.

- Organizations and individuals participating in cultural heritage protection and promotion activities stipulated in Clause 2, Article 87 of the Culture Heritage Law 2024 Download enjoy tax incentives and loan preferences as prescribed by law.
