Are students with disabilities exempt from Physical Education in Vietnam?

How are students with disabilities assessed when they follow the special education method in Vietnam?

According to the provisions of Article 11 of Circular 22/2021/TT-BGDDT regarding the evaluation of students with disabilities as follows:

Evaluation of students with disabilities

1. The assessment of the training and learning results of students with disabilities shall be conducted by motivating and encouraging the efforts and progress of the learners.

2. For students with disabilities learning through the inclusive education method, the training and learning results of subjects that students with disabilities can meet the requirements of the General Education Program will be assessed like normal students but with reduced requirements regarding training and learning results. For subjects that students with disabilities cannot meet the requirements of the General Education Program, the results of training and learning will be assessed according to the Individual Education Plan; no testing or assessment will be conducted on subjects or parts of subjects for which the students are exempt.

3. For students with disabilities learning through the specialized education method, the training and learning results of subjects that students with disabilities can meet the requirements of the specialized education program will be assessed according to the regulations for specialized education. For subjects that students with disabilities cannot meet the requirements of the specialized education program, the results of training and learning will be assessed according to the Individual Education Plan.

For students with disabilities following the specialized education method, the training and learning results of subjects that students with disabilities can meet the requirements of the specialized education program will be assessed according to the regulations for specialized education.

*Note: For subjects that students with disabilities cannot meet the requirements of specialized education, the training and learning results will be assessed according to the Individual Education Plan.

According to Article 10 of Circular 22/2021/TT-BGDDT, which regulates the assessment of students exempted from the practical components of Physical Education, National Defense and Security Education as follows:

Assessment of students exempted from the practical components of Physical Education, National Defense, and Security Education

1. Students facing difficulties in learning due to chronic diseases, disabilities, accidents, or requiring medical treatment are exempted from the practical components of Physical Education, National Defense, and Security Education.

2. The application file for exemption from the practical components of Physical Education, National Defense, and Security Education includes a student's application for exemption and a medical record or certificate of injury issued by a hospital at the district level or above.

3. The exemption from the practical components of Physical Education, National Defense, and Security Education for cases of illness or accident applies within the school year; cases of chronic diseases, disabilities, or long-term injuries apply for the entire school year or entire educational level. The school's principal grants permission for students to be exempted from the practical components of Physical Education, National Defense, and Security Education by each semester or each school year.

4. For students exempted from the practical components of Physical Education, National Defense, and Security Education as prescribed in this Article, the assessment will be replaced by theoretical content to meet the sufficient number of checks and assessments as prescribed.

Thus, according to the above regulations, students with disabilities will be exempted from Physical Education in certain cases:

Case 1: Students with disabilities undergoing treatment are exempted from the practical component of Physical Education.

Case 2: For cases of disabilities, the exemption from Physical Education applies for the entire school year or entire educational level.

*Note: For students exempted from the practical components of Physical Education, the assessment will be substituted with theoretical content to meet the required number of checks and assessments as prescribed.

Do students with disabilities get considered for high school graduation recognition in Vietnam?

Based on Article 42 of the Regulation on High School Graduation Examination issued by the Minister of Education and Training attached to Circular 15/2020/TT-BGDDT regarding recognition of high school graduation as follows:

Recognition of High School Graduation

1. Candidates who are eligible for the exam, not disciplined for exam result cancellation, all exam papers and test subjects of the exam components for graduation recognition achieve over 1.0 point on a 10-point scale and have a graduation evaluation score of 5.0 (five) points or higher will be recognized for high school graduation.

2. Candidates who are eligible for the exam, exempted from all exam papers in consideration for high school graduation according to the regulations in Article 36 of this Regulation will be recognized for high school graduation.

Referring to Article 36 of the Regulation on High School Graduation Examination issued by the Minister of Education and Training attached to Circular 15/2020/TT-BGDDT stipulating the exemption from all exam papers of the high school graduation exam as follows:

...3. Persons with severe disabilities and very severe disabilities as prescribed in Clauses 1 and 2 Article 3 of Decree No. 28/2012/ND-CP dated April 10, 2012 of the Government of Vietnam; persons who participated in the resistance and were exposed to toxic chemicals with a labor capacity decrease of 61% or more; biological children of those who participated in the resistance and were exposed to toxic chemicals, themselves experiencing a labor capacity decrease of 61% or more must meet the following conditions:

a) For persons with disabilities following the general education program: Complete the high school program; meet the conditions for taking the exam as prescribed in Clause 2 Article 12 of this Regulation; have a disability certification issued by a competent authority;

b) For persons with disabilities who cannot meet the general education program: The principal of the high school where the registration is confirmed certifies the performance results of the individual education plan for each year at the high school level; have a disability certification issued by a competent authority;

c) For those who participated in the resistance, biological children of those who participated in the resistance and who were exposed to toxic chemicals: Complete the high school program; meet the conditions for taking the exam as prescribed in Clause 2 Article 12 of this Regulation; have a certification of exposure to toxic chemicals and a labor capacity decrease of 61% or more issued by a competent authority.

Thus, according to the above regulations, students with severe disabilities and very severe disabilities will be exempted from all exam papers of the high school graduation exam if they meet the conditions for taking the exam as prescribed.

Once these conditions for exemption from all exam papers of the high school graduation exam are met and other requirements as prescribed are satisfied, students with disabilities will be considered for high school graduation recognition. Specifically, the conditions are as follows:

- Complete the high school program;

- Meet the conditions for taking the exam as prescribed;

- Have a disability certification issued by a competent authority;

* For students with disabilities who cannot meet the general education program, the following conditions must be met:

- Certified by the principal of the high school where the registration is confirmed for the performance results of the individual education plan for each year at the high school level;

- Have a disability certification issued by a competent authority.
