1. What is Committee for Ethnic Minority Affairs?

According to Article 1 of Decree 66/2022/ND-CP, the Committee for Ethnic Minority Affairs is the Government's ministerial-level agency, performing the state management of ethnic affairs nationwide and the state management of public services under the management of the Committee for Ethnic Minorities in accordance with law.

2. Organizational structure of the Committee for Ethnic Minorities Affairs in Vietnam

The organizational structure of the Committee for Ethnic Minority Affairs in Vietnam includes:

- Financial planning services.

- Organize staff.

- Legal services.

- Department of International Cooperation.

- Department of General Affairs.

- Department of Ethnic Policy.

- Department of Propaganda.

- Department of Ethnic Minorities.

- Department of Local Ethnic Affairs.

- Inspect.

- Office.

- Ethnic Academy.

- Digital Transformation Center.

- Ethnicity and Development Newspaper.

- Ethnic Magazine.

- Ethnic guest house.

(Article 3 of Decree 66/2022/ND-CP)

3. Duties and powers of the Committee for Ethnic Minorities Affairs in Vietnam

The Committee for Ethnic Minority Affairs shall perform the tasks and powers specified in Decree 123/2016/ND-CP; Decree 101/2020/ND-CP, and the following specific tasks and powers:

(1) Submit to the Government a law project, a draft resolution of the National Assembly, an ordinance project, a draft resolution of the National Assembly Standing Committee, and a draft decree of the Government according to the program; the Government's annual law-making plan; and resolutions, projects, and schemes as assigned by the Government and the Prime Minister.

(2) Submit to the Government, the Prime Minister, long-term, medium-term, and annual development strategies, master plans, and important national projects and works in the field of state management of the Committee Nation.

(3) Submit to the Government and the Prime Minister for submission to the National Assembly for promulgation of policies on ethnicity; criteria for identification of ethnic groups; a list of Vietnamese ethnic groups; promulgating specific policies, programs, projects, and schemes for socio-economic development in communes, villages,
villages with difficult socio-economic conditions, especially in ethnic minority and mountainous areas, border communes, and safe zones; investment policies and support to stabilize the lives of ethnic minorities; policies and projects to support people in extremely difficult areas; Conservation and development policies and projects for ethnic minority groups are very few, but ethnic minorities still face many difficulties and have specific difficulties.

(4) Submit to the Government and the Prime Minister for promulgation policies towards reputable people among ethnic minorities; coordinate with relevant ministries and branches to submit to competent authorities for promulgation policies on human resource development, attracting and strengthening cadres, civil servants and public employees working in ethnic minority and mountainous areas; policies on raising people's knowledge, training, fostering and using cadres who are ethnic minorities, specific policies for cadres and civil servants in the system of agencies doing ethnic affairs; policies for ethnic minorities to exercise the right to use their own language and writing, to preserve their national identity, customs, traditions, and culture; policies on investment and development of education and training institutions to meet the needs of education and training for ethnic minorities and mountainous areas.

(5) Submit to the Prime Minister draft decisions, directives, and other documents on ethnic affairs as assigned.

(6) Submit to competent authorities for promulgation or promulgate according to its competence criteria for delimiting ethnic minority areas and mountainous regions by development level a list of communes and villages in ethnic minority areas and mountainous areas according to development levels; the criteria for identifying ethnic minorities still face many difficulties and specific difficulties.

(7) Promulgate circulars, decisions, and directives within the scope of state management of the Committee for Ethnic Minorities; examine legal documents promulgated by ministries, People's Councils and People's Committees of provinces and centrally run cities related to ethnic affairs;

Participate in the development of legal documents related to ethnic minority policies in accordance with regulations on the promulgation of legal documents and relevant current regulations.

(8) Preside over the preliminary, summarizing, and evaluation of the organization and implementation of the Party's guidelines, lines, and policies and the State's laws related to ethnic minority affairs, periodically and irregularly reporting to the Government and Prime Minister as prescribed;

The focal point for uniformly monitoring and synthesizing policies on ethnic minorities, reviewing and urging the implementation of ethnic policies in ministries, ministerial-level agencies, government agencies, and localities;

Recommend competent agencies promulgate, amend, supplement, and complete the policy on ethnic minorities to suit the actual situation, requirements, and tasks of the Party and State's ethnic affairs.

(9) Coordinate with relevant ministries and agencies in planning, allocating investment resources for socio-economic development and other resources for localities in ethnic minority and mountainous areas; propose and participate in the appraisal of programs, projects, schemes, and policies related to ethnic minority and mountainous areas in accordance with law.

(10) Direct, guide, and be responsible for organizing the implementation of legal documents, strategies, master plans, plans, policies, programs, projects, schemes, national target programs, works of national importance, decisions, and directives that have been issued or approved under the state management scope of the Committee for Ethnic Minority Affairs.

(11) Direct and guide the development of advanced examples that are typical collectives, individuals, and reputable people among ethnic minorities;

Commendation according to competence or request competent authorities to reward typical collectives and individuals with outstanding achievements in labor, production, construction, and socio-economic development; maintaining security and order; and exemplary implementation of the Party's guidelines and policies and the State's laws in ethnic minority and mountainous areas.

(12) Direct, guide, and inspect the implementation and organization of congresses of representatives of ethnic minorities at provincial and district levels; organize exchange activities and exchange experiences between representatives of ethnic minorities, reputable people among ethnic minorities, and other events related to ethnic work in order to strengthen the great solidarity of the Vietnamese peoples.

(13) Direct and organize propaganda and mobilization of ethnic minorities to implement the guidelines, guidelines and policies of the Party and laws of the State; promote the fine customs, practices and traditions of the nations; propagating, disseminating and educating the law under the state management of the Committee for Ethnic Minorities; coordinate with relevant ministries and branches in formulating and organizing the implementation of projects and projects to strengthen communication; providing information on ethnic minority and mountainous areas, broadcasting ethnic radio and television channels online on the Internet; coordinate in implementing legal aid policies for ethnic minorities.

(14) Organize and direct scientific research, strategic, fundamental, and urgent issues on ethnic minorities and ethnic minority policies; theoretical research and summarizing the practice of ethnic affairs; application and transfer of science and technology and environmental protection to ethnic minorities and mountainous areas; activities of implementing information technology application and digital transformation; building infrastructure for connection and sharing of information and data in the field of ethnic affairs within the Committee for Ethnic Minorities and outside the Committee for Ethnic Minorities.

(15) International cooperation in the fields under the state management of the Committee for Ethnic Minorities in accordance with the law; attracting resources to support development investment in ethnic minority and mountainous areas, areas with difficult and extremely difficult socio-economic conditions, as prescribed by law; managing, directing, or participating in the implementation of programs and projects sponsored by foreign countries or international organizations; and investing in ethnic minority and mountainous areas in accordance with the law.

(16) Perform management tasks for specialized schools and other educational institutions when assigned by competent authorities in accordance with the law.

(17) Develop a system of statistical indicators under the state management of ethnic affairs, a database system on ethnic affairs, and a dataset on Vietnam's ethnic minorities.

(18) Investigate, survey, research, and synthesize on the socio-economic development of ethnic groups, ethnic groups, names, customs, and practices of ethnic minorities, and other ethnic issues.

(19) Inspect and examine the implementation of policies and laws in the field of ethnic affairs; settle complaints, denunciations, and petitions of citizens; prevent and combat corruption and negativity; and handle violations of the law in the fields under the state management of the Committee for Ethnic Minorities in accordance with law.

(20) Monitor, examine, and summarize the situation of ethnic minorities and mountainous areas, the performance of ethnic minority affairs tasks in ministries, ministerial-level agencies, government agencies, and localities, , propose and recommend competent agencies to consider and settle issues related to ethnic minority affairs and ethnic minorities.

(21) Receive, visit, and coordinate with ministries, branches, and localities in settling the aspirations of ethnic minorities according to the regimes, policies, and provisions of the law.

(22) Decide and organize the implementation of the administrative reform plan, publicize all kinds of administrative procedures in the field of ethnic affairs; and perform other tasks on administrative reform as prescribed by law.

(23) State management of public services in the field of ethnic affairs; perform public services in the field of state management of the Committee for Ethnic Minorities in accordance with law.

(24) Manage organizational structure, civil servant payroll, number of public employees, employment positions, structure of civil servant ranks, and structure of public employees by professional titles; decide on appointment, re-appointment, transfer, rotation, secondment, resignation, relief from duty, dismissal, reward, discipline, severance, retirement, salary regime, and policies on treatment, training, and retraining of cadres, civil servants, public employees, and employees of the Committee for Ethnic Minority Affairs in accordance with regulations.

(25) Develop annual budget estimates; coordinate with the Ministry of Planning and Investment and the Ministry of Finance in making and synthesizing estimates of budget revenues and expenditures by branches and domains under their management for submission to the Government; manage, organize, and finalize the implementation and finalization of the state budget; and perform other tasks on the management of the state budget, finances, and assets in accordance with law.

(26) Perform other duties and powers assigned by the Government or the Prime Minister and in accordance with law.
