1. Specifications of construction design dossier in Vietnam

According to Article 33 of Decree 15/2021/ND-CP, the specifications of construction design dossier are as follows:

- The specifications of construction design dossier are stipulated as follows:

+ COnstruction design dossier is prepared for each project and includes: design explanation, calculations, design drawings, relevant construction survey documents, construction project estimates, technical guidelines, and construction maintenance procedures (if any);

+ Design drawings must have the size, scale, and title block represented according to standards applied in construction activities. In the title block of each drawing, the name and signature of the person directly designing, the person checking the design, the chief designer, and the lead designer must be included. The legal representative of the construction design contractor must verify the documentation and affix the seal of the construction design contractor if the design contractor is an organization;

+ Design explanations, design drawings, and estimates must be compiled into a cohesive documentation set, cataloged, numbered, and symbolized for long-term reference and preservation;

+ The Minister of Construction of Vietnam shall organize the development of national standards on the specifications and content of construction design dossier corresponding to each construction design phase.

- Technical guidelines are stipulated as follows:

+ Technical guidelines form the basis for supervising construction, execution, and acceptance of construction projects. Technical guidelines are prepared by the construction design contractor or another consulting contractor hired by the investor. Approved technical guidelines are a component of the bidding documents for construction, forming the basis for managing construction execution, supervising construction, and accepting projects;

+ Technical guidelines must be consistent with the technical regulations, applicable standards for approved construction projects, and the requirements of the construction design;

+ The investor requires the construction design contractor or another consulting contractor to prepare separate technical guidelines for special-grade, Grade I, and Grade II projects. For other projects, technical guidelines can be prepared separately or stipulated in the construction design explanation.

- Construction design dossier is a component of the project completion dossier and must be archived according to the regulations of the Government of Vietnam on quality management and maintenance of construction projects and archiving laws.

2. Guidelines for managing construction design work in Vietnam

According to Article 34 of Decree 15/2021/ND-CP, the management of construction design tasks in Vietnam is as follows:

- The construction design contractor is responsible for the quality of the construction design they perform; the verification, appraisal, and approval of the construction design by individuals, organizations, investors, decision-makers, or professional construction bodies neither replace nor diminish the responsibility of the construction design contractor for the quality of the design they perform.

- If the construction design contractor acts as the design general contractor, they must undertake the main design tasks of the project and bear full responsibility for fulfilling the contract with the contracting party. The subcontracting design contractor is responsible for the progress and quality of the construction design before the general contractor and before the law for the parts they are responsible for.

- During the design process of projects that are of national importance, large scale, or have complex technology, the construction design contractor has the right to propose that the investor conduct experiments and simulations to verify and calculate the construction’s performance to perfect the design, ensuring technical requirements and project safety.

- After the construction design dossier is evaluated and approved under the regulations, the investor checks the completed work volume and the compliance regarding the specifications and quantity of design documentation according to the construction contract provisions, and notifies the construction design contractor in writing if the design documentation meets the required standards for acceptance inspection.
