What are the duties of the National Defense and Security Council in Vietnam?

According to Article 89 of the Constitution 2013, the National Defense and Security Council in Vietnam is defined as follows:

- The National Defense and Security Council consists of the Chairman, Vice Chairman, and members. The list of members of the National Defense and Security Council is submitted to the National Assembly for approval by the President.

The National Defense and Security Council operates on a collective basis and makes decisions by majority.

- Duties of the National Defense and Security Council:

+ The National Defense and Security Council submits to the National Assembly to decide on the state of war, and if the National Assembly cannot convene, it submits to the Standing Committee of the National Assembly for a decision;

+ Mobilize all forces and capabilities of the country to defend the Fatherland;

+ Perform special duties and powers assigned by the National Assembly during wartime;

+ Decide on the participation of the people's armed forces in activities contributing to peace in the region and the world.

What are the current duties and powers of the President of Vietnam?

The President of Vietnam has the duties and powers as stipulated in Article 88 of the Constitution 2013 as follows:

- Promulgate the Constitution, law, and ordinances; suggest the Standing Committee of the National Assembly re-examine an ordinance within ten days from the date it was passed, if the ordinance is still approved by the Standing Committee of the National Assembly and the President still disagrees, the President shall submit it to the National Assembly for decision at the nearest session;

- Propose to the National Assembly the election, dismissal, or removal of the Vice President, Prime Minister of the Government of Vietnam; based on a resolution of the National Assembly, appoint, dismiss, or remove Deputy Prime Ministers of the Government of Vietnam, Ministers, and other members of the Government of Vietnam;

- Propose to the National Assembly the election, dismissal, or removal of the Chief Justice of the Supreme People's Court, the Procurator General of the Supreme People's Procuracy; based on a resolution of the National Assembly, appoint, dismiss, or remove Judges of the Supreme People's Court;

- Appoint, dismiss, or remove the Deputy Chief Justice of the Supreme People's Court, judges of other courts, Deputy Procurator Generals, and Procurators of the Supreme People's Procuracy; decide on special amnesty; based on a resolution of the National Assembly, announce decisions on general amnesty;

- Decide on awarding orders, medals, state prizes, state honorary titles; decide on granting, renouncing, restoring, or depriving Vietnamese nationality;

- Commander-in-chief of the people's armed forces, serving as Chairman of the National Defense and Security Council, decide on the promotion, demotion, or stripping of ranks of generals, rear admiral, vice admiral, and admiral navy;

- Appoint, dismiss, or remove the Chief of General Staff, Director of the General Political Department of the Vietnam People's Army; based on resolutions of the National Assembly or the Standing Committee of the National Assembly, announce or abolish decisions declaring a state of war; based on a resolution of the Standing Committee of the National Assembly, issue a general or partial mobilization order, announce or abolish a state of emergency; if the Standing Committee of the National Assembly cannot convene, announce or abolish a state of emergency nationwide or in particular localities;

- Receive foreign ambassadors; based on resolutions of the Standing Committee of the National Assembly, appoint, dismiss; decide on the accreditation or recall of ambassadors of the Socialist Republic of Vietnam;

- Confer ambassadorial titles and ranks; decide on negotiating and signing international treaties on behalf of the State; submit international treaties for National Assembly approval, decide on joining or terminating the effectiveness of international treaties as stipulated in Clause 14, Article 70 of the Constitution 2013; decide on approval, joining, or terminating the effectiveness of other international treaties on behalf of the State.
