According to Clause 1, Article 3 of Resolution 96/2023/QH15, get a vote of confidence means the National Assembly and People's Council exercising the right to supervise and assess the creditworthiness of position holders elected or approved by the National Assembly or People's Council as a basis for cadre consideration and assessment.
According to Clause 2, Article 3 of Resolution 96/2023/QH15, a vote of confidence means the exercise of the right by the National Assembly or the People's Council to supervise and evaluate the confidence or non-confidence of a person holding a position elected or approved by the National Assembly or the People's Council to serve as a basis for the dismissal or approval of the request for dismissal of persons who are not trusted by the National Assembly or the People's Council.
3. Purpose of and request for collection, and casting of votes of confidence in Vietnam
The purpose of and request for the collection and casting of votes of confidence in accordance with Article 4 of Resolution 96/2023/QH15 are as follows:
- The collection of votes of confidence in order to improve the effectiveness and efficiency of supervision activities of the National Assembly and People's Councils; the quality and operational efficiency of the state apparatus;
Contribute to the assessment of the reputation and performance of the assigned tasks and powers of the person receiving the vote of confidence, helping them see their trust level to continue to strive, train, and improve the quality and efficiency of work; serve as a basis for competent agencies and organizations to consider planning, training, fostering, arranging, and employing cadres.
- The organization of collection and casting of votes of confidence must be carried out in accordance with Resolution 96/2023/QH15 and other relevant provisions of law, ensuring its substance, contributing to strengthening the confidence of voters and the people. Violations of the law on taking votes of confidence and voting of confidence must be handled in accordance with the law.
Principles of collection and casting of votes of confidence according to Article 5 of Resolution 96/2023/QH15 are as follows:
- Ensuring the rights and upholding the responsibilities of National Assembly deputies and People's Council deputies in taking votes of confidence and voting of confidence; ensuring the right to report and give explanations of the person receiving the vote of confidence or vote of confidence.
- Democracy, objectivity, fairness, openness, and transparency; to ensure the true assessment of the results of performance of tasks, powers, and political, moral, and lifestyle qualities of the person receiving the vote of confidence.
- Ensure the stability and operational efficiency of the state apparatus and the Party's leadership in cadre work.
Based on the assessment of the credit rating of the person receiving the vote of confidence, vote for confidence in accordance with Article 6 of Resolution 96/2023/QH15 as follows:
- Political qualities, ethics, lifestyle, and observance of the Constitution and laws, including the following contents:
+ The stance, viewpoints, and political bravery in implementing the guidelines and guidelines of the Party, policies, and laws of the State; preserving political, moral, and lifestyle qualities; sense of responsibility at work, attitude to serve the People; need, thrift, integrity, righteousness, justice, impartiality, honesty, fairness, objectivity, initiative, and creativity in performing assigned tasks and powers;
+ Observance of the Constitution and laws, sense of discipline; the implementation of the principle of democratic centralism, self-criticism, and criticism; compliance with regulations of agencies and units where they work; ability to gather, unite internally, and handle difficult, complex, and sensitive issues;
+ The implementation of things that party members, cadres, and civil servants are not allowed to do and the responsibility to set an example; the example of themselves and their spouses and children in the observance of the State's policies and laws.
- Results of performance of assigned tasks and powers, including the following contents:
+ Results of leadership, advice, and organization of implementation of the Party's guidelines and policies and laws of the State in the fields and scope of responsibility; dynamism, innovation, creativity, decisiveness, dare to think, dare to do, and dare to take responsibility in performing assigned tasks and powers;
+ Results of leading and directing the implementation of the Party's guidelines and the State's laws on the fight against corruption and negativity, practicing thrift, and fighting wastefulness; results of leadership in organization and staffing, attracting and appreciating talents; examination, inspection, and supervision;
+ Quantity and quality of products, efficiency of performance of assigned tasks and powers; the level of task completion of organizations, agencies, and units under their management;
+ Results of implementation of resolutions and conclusions on thematic supervision, on questions, and other resolutions and conclusions of the National Assembly, the National Assembly Standing Committee, and the People's Council;
Conclusion and recommendations of the Ethnic Council, Committee of the National Assembly, Delegation of the National Assembly, National Assembly deputies, Standing Committee of the People's Council, Committee of the People's Council,
Deputies of the People's Council and the People's Council;
Results of settlement of complaints and denunciations, receipt and settlement of petitions, and reflections of voters and people in the fields and scope of their charge; performance of commitments and promised issues (if any).
