Regarding this issue, LawNet would like to answer as follows:
Specifically, Article 5 of Circular 7/2020/TT-BYT stipulates the purchase price of specialized automobiles in the medical field as follows:
(i) The purchase price of a special-use car specified in (i) is the purchase price that includes all taxes payable according to the provisions of law; it does not include registration fees, license plate fees, insurance fees, registration fees, or road maintenance fees related to vehicle use.
(ii) If a car is exempt from taxes, the exempted tax amount must be calculated to determine standards and usage norms.
In case of transferring or receiving used automobiles, the car price used as a basis for determining standards and norms is the remaining value on accounting books or re-evaluation value according to the provisions of law (for automobiles whose value has not been tracked in accounting books or cases that must be re-evaluated when handled according to the provisions of law).
(iii) Funding sources for investment and procurement of specialized automobiles in the medical field, including: state budget; types of funding originating from the state budget (public service development fund, service fee revenue, etc.); loan capital; official ODA development support capital (except in cases where there is a separate agreement); sources of support; sponsorship; donations from domestic and international organizations and individuals; and other legal funding sources according to the provisions of law.
According to Article 4 of Circular 7/2020/TT-BYT, standards and norms for specialized automobiles in the medical field are regulated as follows:
(1) For agencies and units with medical examination and treatment functions.
- Under 50 hospital beds are assigned 01 vehicle.
- From 50 beds to less than 100 beds, 02 vehicles are assigned.
- From 100 beds to less than 200 beds, 03 vehicles are assigned.
- From 200 beds to less than 300 beds, 04 vehicles are assigned.
- From 300 hospital beds or more, if there is an increase of 150 hospital beds, the norm is to add 01 additional vehicle.
(2) In cases where medical examination and treatment facilities need to equip ambulances with special structures, the determination of standards and norms for ambulances is based on the criteria stipulated in Article 4 of Circular 7/2020/TT-BYT.
(3) For agencies and units specializing in providing emergency services and patient transportation support:
Determining standards and norms for using ambulance automobiles is based on demand, population size, geographical location, and statistics on the number of emergency services and patient transportation in the last 3 years as a basis for proposing norms to report to competent authorities for consideration and appraisal on the principle of ensuring appropriate quantities associated with investment and effective use of automobiles.
Particularly for determining standards and norms for the use of specialized automobiles with special structures and specialized automobiles equipped with or using specialized equipment for medical professional work based on the following criteria:
- Functions, tasks, and powers approved by competent authorities.
- The organizational structure and scale of operations are approved by competent authorities in the Charter of organization and operations; Development planning (if any) and specific characteristics of medical agencies and units.
- Scope and area of operation, population size.
- Quantity and frequency of use of each type of car at the time of establishing norms and expected demand for use of each type of car in the next 03 years. In the case of a newly established medical agency or unit, it is only necessary to estimate the demand for each type of car in the next 3 years.
