Regarding this issue, LawNet would like to answer as follows:

The Ministry of Home Affairs is collecting comments on a draft Decree stipulating policies to attract and utilize talented people in state administrative agencies and public service units (abbreviated as draft Decree).

1. What is a talented person?

According to Article 3 of the draft Decree, talented people are people with moral qualities and a standard lifestyle who have the desire to contribute to and serve the Fatherland and the People; have outstanding qualifications, and have creative capacity; There are works, products, achievements, merits, or special contributions that create progress and development in a field, industry, locality, or country.
in industries and fields of social life.

2. Propose policies to utilize talented people in state administrative agencies in Vietnam

2.1 Policy of using talented people as officials, civil servants, public employees, and workers in Vietnam

(i) Policy on working environment and working equipment

- Attend and express opinions at meetings related to the professional work of the leadership of the agency or organization currently working;

- Be assigned and arranged by competent authorities to assist people (or a group) in performing specific tasks. The assigned person (or group) is responsible for performing the tasks required by the talented person;

- Invest in equipment and working facilities to perform assigned tasks well. Where necessary, resources and special equipment will be invested to implement the contents of programs, projects, topics, and scientific research projects that have been assessed by competent authorities as feasible and recommended for practical application;

- Arrange and arrange human and material resources to serve professional activities and scientific research during specific tasks, including outside working hours;

- Facilitated access to documents to serve professional activities and scientific research;

- Propose estimates and use of funds to perform specific tasks or tasks; Be responsible before the law and competent authorities for the use of assigned funds.

(ii) Policy on planning and appointment

- Priority in consideration: selection for planning, appointment to leadership, management, or leading expert positions in the field of work, regardless of the number of years of work;

- In the event that they are accepted but do not meet the conditions for recruitment as civil servants or public employees, priority will be given to signing professional contracts for appointments to executive and management positions in public service units.

(iii) Salary and welfare policies

- Every month, talented people receive an incentive amount equal to 100% of their current salary. The incentive amount is not used to calculate social insurance and health insurance benefits. The incentive amount is determined in the regular expenditure estimate and allocated to agencies, organizations, units, and localities according to the provisions of the Law on State Budget.

- Priority in being considered for salary increase ahead of time (if any) or consideration for civil servant rank promotion, consideration for promotion of civil servant professional title without requirement on time holding rank or title class if there are particularly excellent achievements in public service activities, professional activities, or is ranked in quality at the level of excellent completion of tasks for 03 consecutive years from the date of recruitment decision;

- Priority is given to renting official housing or borrowing money to buy housing in installments under the guarantee of agencies and organizations from the Bank for Social Policies with preferential interest rates according to Government regulations;

- Maintain the same regime and policies while being sent for training and retraining. In case the study location is not in the locality of the work place, you will enjoy the same benefits as those who are sent on business trips;

- When transferred or seconded by a competent authority to take on tasks in difficult areas, they will receive support with housing and living conditions to stabilize work and continue to enjoy benefits and policies for cadres, civil servants, public employees, and talented workers; At the end of the rotation or secondment period, if the task is completed, agencies with authority to manage cadres, civil servants, and public employees are responsible for returning employees to their previous positions or assigning them to other, higher positions in accordance with their talents and professional expertise;

- When you reach retirement age, if you are healthy enough, you voluntarily continue to work, and the agency or unit has a need, the head of the agency managing cadres, civil servants, and public employees shall consider and decide to extend the working time and maintain the position and title that the cadre, civil servant, and public employee is currently holding, but not more than 5 years.

(iv) Be honored and rewarded according to the provisions of the law.

(v) Enjoy other preferential regimes according to the regulations of ministries, branches, and localities.

2.2 Policy of recruiting talented people to attract people

- Enjoy the policy specified in clause (i), have priority to rent official housing, or borrow money to buy housing in installments according to clauses (iii), (iv), and (v) in Section 2.1.

- Every month, receive a minimum incentive amount for talented people equal to 100% of the salary granted after being recruited; Higher incentive levels are decided by the agency's managing cadres, civil servants, public employees, and workers in accordance with the actual conditions of the agency or organization. The incentive amount is not used to calculate social insurance and health insurance benefits. The incentive amount is considered and decided by the head of the agency employing talented people and is determined in the regular expenditure estimate and allocated to agencies, organizations, units, and localities according to the provisions of the Law on State Budget.
