1. Procedures for approval of annual civil servant payroll in Vietnam

Procedures for approval of annual civil servant payrolls is specified in Article 10 of Decree 62/2020/ND-CP as follows:

- Agencies and organizations under ministries, branches, and localities shall base themselves on Clause 2, Article 4 of Decree 62/2020/ND-CP and provide guidance from competent agencies on the norms of civil servant staffing to develop the annual civil servant payroll plans of their agencies or organizations and send them to agencies and organizations as prescribed.

- Agencies and organizations assigned with the task of organizing and staffing ministries, branches, and localities shall receive dossiers and appraise annual staffing plans of agencies and organizations; synthesize and plan annual civil servant payrolls of ministries, branches, and localities for ministries, branches, and localities to send to the Ministry of Home Affairs for appraisal.

- The Ministry of Home Affairs appraises the annual civil servant payroll plans of ministries, branches, and localities; summarizes the annual staffing plan for civil servants of ministries, branches, and localities and submits it to the Prime Minister for approval; and decides on the assignment of civil servant payrolls to each ministry, branch, or locality after being approved by the Prime Minister.

- Ministries, branches, and localities shall decide to assign civil servant payrolls to each agency or organization under the ministry, branch, or locality out of the number of civil servant payrolls assigned by competent authorities.

2. Contents of the annual civil servant payroll plan in Vietnam

The contents of the annual civil servant payroll plan include:

- The need for annual civil servant payroll planning.

- Report on the evaluation of the assignment and use of civil servant payrolls for the year preceding the plan year at the time of planning.

- Determine the payroll of civil servants for the plan year; together with the statistics and synthesis of civil servant payroll data for the plan year according to Appendix IA or Appendix IB issued together with this Decree.

- Solutions for implementing the civil servant payroll plan after being assigned or approved by the competent authority, expected additional and replacement sources of civil servants, implementing the policy of downsizing the payroll, and estimating the funding for implementation

- Recommendations, suggestions.

3. Application and deadlines for sending annual civil servant payroll plans in Vietnam

3.1. Application for annual civil servant payroll plan in Vietnam

Application for annual civil servant payroll plan, including:

- A written request for an annual civil servant payroll plan;

- The annual staffing plan of the agency or organization according to the provisions of Article 11 of this Decree;

- Copies of documents of competent agencies or persons competent to decide or approve civil servant payrolls for the year preceding the plan year.

3.2. Deadline for sending the annual civil servant payroll plan in Vietnam

- No later than June 15 of each year, ministries, branches, and localities shall send civil servant payroll planning dossiers to the Ministry of Home Affairs for appraisal.

- No later than July 20 each year, the Ministry of Home Affairs shall submit to the Prime Minister for approval the total payroll of civil servants of ministries, branches, and localities.

- In case ministries, branches, and localities fail to send civil servant payroll plans on time, the Ministry of Home Affairs shall submit to the Prime Minister for consideration and decision the staffing of civil servants of that ministry, branch, or locality with a downsizing rate 1% higher than the rate of downsizing according to the annual roadmap.

4. Adjustment of civil servant payroll in Vietnam

- The adjustment of civil servant payrolls in agencies and organizations shall be considered in the following cases:

+ The agency or organization has changed one of the grounds specified in Clause 2, Article 4 of this Decree;

+ Establishing, reorganizing, or dissolving agencies or organizations under the decisions of competent agencies; establishment, dissolution, merger, division, and adjustment of the boundaries of administrative units at provincial and district levels.

- Dossiers and order of adjustment of civil servant payrolls:

+ Dossiers for the adjustment of civil servant payrolls include: a written request for the adjustment of civil servant payrolls; the scheme for the adjustment of civil servant payrolls; documents related to the adjustment of civil servant payrolls attached;

+ For the increase of civil servant payrolls or the transfer of civil servant payrolls between ministries, branches, and localities, the ministries, branches, and localities shall send dossiers of adjustment of civil servant payrolls specified at Point a, Clause 2, Article 13 of Decree 62/2020/ND-CP to the Ministry of Home Affairs for appraisal and submission to the Prime Minister for decision;

+ Regarding the transfer of civil servant payrolls between ministries, branches, localities, and agencies and organizations specified in Clause 1, Article 21 of Decree 62/2020/ND-CP, the ministries, branches, and localities shall send dossiers of payroll transfer of civil servants specified at Point a, Clause 2, Article 13 of Decree 62/2020/ND-CP to the Ministry of Home Affairs for decision. The Ministry of Home Affairs shall summarize and report to the Prime Minister when submitting to the Prime Minister for approval the annual payroll of civil servants.
