Regarding this issue, LawNet would like to answer as follows:

1. Who are party members?

According to Article 1 of the Charter of the Communist Party of Vietnam, a party member is a revolutionary soldier in the vanguard of the working class, the toiling people, and the Vietnamese nation, striving all his life for the purposes and ideals of the party, putting the interests of the Fatherland, the working class, and the working people above personal interests;

Adhering strictly to the political platform, the party charter, the party's resolutions, and the laws of the state; having employees who successfully complete the assigned tasks; having morals and a healthy lifestyle; being closely associated with the people; obeying the party's organization and discipline; and maintaining the party's unity.

2. Procedures and ways to calculate party age with party members in Vietnam

Procedures and ways to calculate party age for party members according to Instruction 01-HD/TW dated September 28, 2021 are as follows:

- Party age of a party member is counted from the date the competent authority signs the decision on admission of a party member.

Getting the date of joining the Party stated in the party membership card (in case a person has left the Party and has previously been confirmed with party age, the party age cannot be recalculated according to this regulation).

- For those who have been removed from the Party and have been examined and verified by competent authorities and concluded that they have been unjustly or wrongly and since being removed from the Party until now, without violating the party membership status, the party membership rights will be restored, the party age is counted continuously.

Party members are responsible for paying the full amount of party fees to the cell during the interruption of party activities according to the amount of party fees prescribed during that time.

- Being re-admitted party members must make a declaration of their party's age and report it to the cell; the branch shall verify and report to the grassroots Party Committee; The grassroots Party Committee shall appraise and report to the immediate superior Party Committee.

The Standing Committee of the superior Party Committee directly considers and issues a decision to recalculate the party age for party members (The recalculation of party age for expelled party members has a definite time in accordance with the Party Charter, term II, the time of loss of contact with the party organization and the interruption due to changing party activities shall comply with the provisions of this Law).

3. Duties of Party members in Vietnam

According to Article 2 of the Charter of the Communist Party of Vietnam, the duties of party members are as follows:

- Be completely committed to the revolutionary ideals of the party; strictly adhere to the political platform, the party's charter, the party's resolutions and directives, and the laws of the state; successfully complete the assigned tasks; fully submit to the party's assignment and maneuvering.

- Constant study, practice, and improvement of knowledge, working capacity, political qualities, revolutionary ethics, and a healthy lifestyle; combating individualism, opportunism, partiality, bureaucracy, corruption, waste, and other negative manifestations.

Comply with the Central Committee's regulations on what party members can't do.

- Maintain close contact with the people, respect and promote the people's right to mastery, care for the material and spiritual lives of the people, and protect the people's legitimate interests; actively participate in mass work and social work at work and at home; propagandize and mobilize families and people to implement the party's guidelines and policies, as well as state laws.

- Participate in building and protecting the Party's lines, policies, and organization; obey discipline, maintain unity and unity in the Party; regularly self-criticize and critique, be honest with the Party; do party member development work; participate in party activities; and pay party fees in accordance with regulations.
