1. Position and functions of the Forest Protection Department in Vietnam

- The Forest Protection Department is an organization under the Ministry of Agriculture and Rural Development, based on the arrangement and consolidation of the General Department of Forestry into the Forest Protection Department and the Forestry Department.

The Forest Protection Department performs the function of advising and assisting the Minister of Agriculture and Rural Development in the state management of forest management and protection, ensuring compliance with forestry laws; and organizing specialized forces for forest fire prevention and fighting under the Ministry's state management according to the decentralization and authorization of the Minister.

- The Forest Protection Department has legal status and its own seal and account; operating funds are provided by the state budget according to the provisions of law.

- The headquarters of the Forest Protection Department are located in Hanoi.

2. Organizational structure of the Forest Protection Department in Vietnam

The organizational structure of the Forest Protection Department is specified in Article 3 of Decision 1586/QD-BNN-TCCB 2023 as follows:

* Department leaders:

- The Forest Protection Department has a Director and Deputy Directors appointed and dismissed by the Minister of Agriculture and Rural Development according to regulations;

- The Director of the Department manages the Department's activities and is responsible before the Minister and the law for operating the Department's activities. The Deputy Director helps the Director monitor and direct some aspects of work as assigned by the Director, and is responsible before the Director and the law for assigned tasks.

- The Director of the Department is responsible for submitting to the Minister regulations on the functions, tasks, powers, and organizational structure of the Department; promulgating the Department's working regulations; regulating the functions, tasks, and powers of advisory organizations under the Department; organizations with legal status under the Department after receiving written approval from the Ministry; and appointing and dismissing leadership and management positions under the Department according to the Minister's decentralization and provisions of law.

- Region I Forest Protection Department, headquartered in Quang Ninh province;

* The Vietnam CITES management authority is located at the Forest Protection Department; The Director and Deputy Director of the Vietnam CITES Management Authority are appointed and dismissed by the Minister of Agriculture and Rural Development according to the provisions of law.

The Director of the Forest Protection Department is responsible for building and consolidating the organization and operations of the Vietnam CITES Management Authority and submitting it to the Minister of Agriculture and Rural Development for approval and implementation according to regulations of the Law.
