What are the regulations on indoor smoking-free locations in Vietnam? - Huu Tien (Kien Giang)
Pursuant to Clause 3, Article 1 of Circular 11/2023/TT-BYT, places where smoking is completely prohibited indoors include:
(1) Indoor workplaces of state administrative agencies, public non-business units, enterprises, political organizations, socio-political organizations, social organizations, socio-professional organizations, and workplaces of other agencies, organizations, and units, except for the following locations:
- Non-smoking locations in the house and within the premises.
- Places where smoking is prohibited in the house but allowed to have a designated smoking area.
(2) Indoor areas of public places: food service establishments, entertainment service establishments, railway stations, docks, bus stations, religious and belief establishments, convention centers, commercial centers, markets, theaters, cultural houses, cinemas, circuses, clubs, sports halls, stadiums, community houses, and the common living areas of the apartment complex and other public places, excluding the locations:
- Non-smoking locations in the house and within the premises.
- Places where smoking is prohibited in the house but allowed to have a designated smoking area.

In there:
+ Sites where smoking is completely prohibited indoors and within the premises include:
++ Medical facilities;
++ Educational institutions;
++ Care, nurture, play, and entertainment facilities exclusively for children;
++ Establishments or areas with high risk of fire and explosion as specified in Appendix II to the List of establishments at Risk of Fire and Explosion issued together with Decree 136/2020/ND-CP.
+ Places where smoking is prohibited in the house but allowed to have a place dedicated to smokers:
++ Airport isolation area;
++ Bars, karaoke bars, discos;
++ Hotels, motels, guest houses, resorts and other tourist accommodation establishments;
++ Public means of transport are ships and trains.
- Having placed, printed, or arranged (hereinafter referred to as placing) signs, letters, or symbols with content prohibiting smoking (hereinafter collectively referred to as signs).
Agencies, organizations, and individuals refer to Forms No. 1 and No. 2 in Appendix 1 issued together with Circular 11/2023/TT-BYT.
- The sea must meet the following requirements:
+ The message content is clear, easy to understand, and concise;
+ Durable marine material, hard to fade; signs placed outdoors withstand the impact of the external environment;
+ The size and font size of the signboard are suitable for the position and space of the signboard; bold, easy-to-read text; font color, icon contrast with background color;
+ Signboards placed in public places in insufficient light conditions: with reflectors, marine lighting, or other suitable forms to ensure easy viewing.
- The placement of signs must satisfy the following requirements:
+ The distance between the seas is suitable for the scale and space of each location;
+ Put the sign in an easy-to-observe position, in an area with a lot of people passing by; entrance gate to campus area, outdoor parking area; for indoor areas located at doors, front halls, reception areas, waiting chairs, floors of stairs, in elevators, covered corridors, garages, toilets.
- There are no ashtrays, smoking utensils, butts, or cigarette butts in the smoking-free area.
