Regarding this issue, LawNet would like to answer as follows:
- In case a public service unit is assigned recruitment authority, the Recruitment Council has 05 or 07 members, including:
+ The Chairman of the Council is the head or deputy head of the public non-business unit;
+ The Vice Chairman of the Council is the person in charge of the personnel organization of the public non-business unit;
+ Member and Secretary of the council is an officer assisting in the organization and staff work of public service units;
+ Other members are people with expertise and skills related to recruitment, as decided by the head of the public service unit.
In case the Chairman of the Recruitment Council cannot be arranged, the agency competent to manage the public service unit shall consider and decide.
- In case the agency competent to manage a public service unit conducts the recruitment, the Recruitment Council has 05 or 07 members, including:
+ The Chairman of the Council is the head or deputy head of the agency with recruitment authority;
+ The Vice Chairman of the Council is the leader of the staff organization advisory department of the agency with recruitment authority;
+ Member and Secretary of the Council are the representatives of the staff organization advisory department of the agency with recruitment authority;
+ Other members are people with expertise and skills related to recruitment organizations, as decided by the head of the agency with recruitment authority.
Note: Do not assign people who are related to the candidate's father, mother, brother, sister or spouse; spouse, biological child or adopted child of the candidate or those who are within the disciplinary time limit or are executing disciplinary decisions as members of the Recruitment Council, members of the assisting sections of the Recruitment Council.
(Clause 1, 2, 4 Article 8 of Decree 115/2020/ND-CP)
The recruitment council works on the principle of collectivity and makes decisions by majority; in case of equal votes, the opinion voted by the Chairman of the Recruitment Council shall be followed. The Recruitment Council has the following duties and powers:
- Establishment of supporting departments: Examination board for application registration forms, Exam question board, Exam proctoring board, Beating board, Exam marking board, Review review board (if any); Examination Board when conducting interviews or practice in round 2;
In case of necessity, the Chairman of the Recruitment Council shall establish a secretariat to assist;
- Organize recruitment fee collection and use recruitment fee according to regulations;
- Check the application registration form, organize exams, mark exams, and re-evaluate according to regulations;
- Report to the head of the agency or unit with recruitment authority to decide on recognition of exam and admission results;
- Settlement of complaints and denunciations during the recruitment and selection examination;
- The recruitment council dissolves itself after completing its tasks.
(Clause 3, Article 8 of Decree 115/2020/ND-CP)
The grounds for public employee recruitment are specified in Article 4 of Decree 115/2020/ND-CP as follows:
- Recruitment of public employees must be based on job needs, job position, professional title standards, and the salary fund of the public service unit.
- Agencies and units with authority to recruit public employees develop recruitment plans, report to agencies with authority to manage public employees for approval, or decide according to their authority as a basis for recruitment before each recruitment period. The contents of the recruitment plan include:
+ Number of assigned workers and number of unused workers of public service units employing public employees;
+ Number of officials needed to recruit for each job position;
+ Number of job positions to be recruited for ethnic minorities (if any), clearly defining the criteria and ethnic structure to be recruited;
+ Standards and conditions for applying for each job position;
+ Form and content of entrance examination or admission;
+ Other contents (if any).
