Regulations on the Inspection of Labor Beyond Official Working Hours and at Night

The Ministry of Labor, Invalids, and Social Affairs has just issued Circular 20/2018/TT-BLDTBXH guiding the coordination mechanism in conducting specialized inspections of labor, safety, and occupational hygiene at night and outside of regular working hours.

The entities shall cooperate with each other in night-time and after-hours labor inspection as stipulated below:

- Within a maximum period of 04 hours from receiving information about a labor violation, the Chief Inspector of the Ministry of Labor - Invalids and Social Affairs (MOLISA) and the Director of the Department of Labor - Invalids and Social Affairs (DOLISA) shall notify the focal unit to confirm participation in the inspection team;- The Chief Inspector of MOLISA or the Director of DOLISA shall issue the Inspection Decision within a maximum period of 04 working hours from the notification to the relevant agencies regarding the law violation and the request to assign personnel to the inspection team;- The head of the inspection team must announce the inspection decision and proceed with the inspection at the place of violation within a maximum period of 12 hours from the issuance of the inspection decision;- Implement or recommend implementing measures to address the violations.
