Law on Cybersecurity 2018: Prohibited Acts in Cyberspace in Vietnam

From January 01, 2019, the Cybersecurity Law 2018 will officially come into effect. This law has a specific article that stipulates the acts that service users are strictly prohibited from engaging in on cyberspace in Vietnam.

Full text of the 2018 Cybersecurity Law approved by the National Assembly of Vietnam

Article 8 of the 2018 Cybersecurity Law stipulates:

"1. Utilizing cyberspace to perform the following acts:

a) The acts specified in Clause 1, Article 18 of this Law;

b) Organizing, operating, conspiring, inciting, bribing, deceiving, luring, training, or coaching individuals against the State of the Socialist Republic of Vietnam;

c) Distorting history, denying revolutionary achievements, sabotaging the national great unity bloc, offending religions, gender discrimination, racial discrimination;

d) Disseminating false information causing confusion among the people, damaging socio-economic activities, hindering the activities of State agencies or public officials, infringing upon the lawful rights and interests of other organizations or individuals;

đ) Engaging in prostitution, social evils, human trafficking; posting obscene, depraved, or criminal information; destroying the nation's fine customs, social ethics, community health;

e) Inciting, luring, or motivating others to commit crimes.

2. Conducting cyberattacks, cyberterrorism, cyberespionage, cybercrime; causing incidents, attacks, infiltrations, taking control, altering, disrupting, stalling, paralyzing, or destroying crucial information systems related to national security.

3. Producing, using tools, means, or software to obstruct, disrupt the operation of computer networks, telecommunications networks; spreading harmful software that affects the operation of computer networks, telecommunications networks, electronic devices; unauthorized access to computer networks, telecommunications networks, or electronic devices of others.

4. Opposing or obstructing the activities of the cybersecurity protection force; illegally attacking or disabling measures to protect cybersecurity.

5. Exploiting or abusing cybersecurity protection activities to infringe the sovereignty, interests, national security, social order, safety, lawful rights and interests of organizations and individuals, or for profiteering.

6. Other acts violating the provisions of this Law."

In which, the prohibited acts specified in Clause 1, Article 18 are identified as acts of using cyberspace, information technology, electronic means to affect national security, social order, and safety, such as: Posting and spreading information on cyberspace with content that propagandizes against the State, distorting, inciting, luring to gather, disrupting public order; defamation, fictional, false information affecting the honor, dignity, and interests of others, causing confusion among the people and damaging socio-economic activities.
