This is a notable content mentioned in the Circular No. 41/2020/TT-BGTVT dated December 31, 2020 of the Ministry of Transport of Vietnam amendments to the Circular No. 13/2019/TT-BGTVT on elaboration of Vietnam’s aviation security program and aviation security quality control.
Pursuant to Clause 36 Article 1 of the Circular No. 41/2020/TT-BGTVT of the Ministry of Transport of Vietnam (amending Article 57 of the Circular No. 13/2019/TT-BGTVT), the airline shall incur all costs in connection with passengers denied entry, except for the case that a passenger holding foreign nationality has entered Vietnam and then left Vietnam for the third country but is denied entry and forced to return to Vietnam, the airline shall transport such passenger back to Vietnam and transfer him/her to the border checkpoint police authority and the airline shall cooperate with the border checkpoint police authority in verifying his/her itinerary, identity information and nationality. (This is a new content amended in Circular No. 41/2020/TT-BGTVT, compared to Circular No. 13/2019/TT-BGTVT)
Moreover, if the airline transports passengers denied entry to a foreign country back to Vietnam, the airline shall cooperate with the competent authority of the home country to obtain their identity documents or other documents issued by the competent authority of the home country for the purpose of transporting such passengers.
