Standards for consideration of promotion to grade-I preschool teachers from December 15, 2024

On October 30, 2024, the Minister of Education and Training of Vietnam promulgates Circular No. 13/2024/TT-BGDDT on standards and requirements for consideration of preschool teachers’, public high school teachers’, and cram school teachers' promotion. According to the Circular, a preschool teacher may apply for being considered as a grade-I preschool teacher (code V.07.02.24) if he/she meets all of the following standards and requirements:

- He/she has been appointed to be a grade-II preschool teacher (code V.07.02.25).

- During the period of teaching as a grade-II preschool teacher or in the equivalent position, he/she is recognized for good performance of tasks or higher for 05 years preceding the year of promotion exam, and excellent performance of tasks for at least 02 years of which; is good in political qualities and professional ethics; is not within the time limit for disciplinary action; is not within the period of implementation of regulations related to discipline in accordance with the CPV's regulations and the law.

- He/she meets the standards of training qualifications for a grade-I preschool teacher as prescribed in Point a, Clause 3, Article 5 of Circular No. 01/2021/TT-BGDDT and Clause 2, Article 1 of the Circular No. 08/2023/TT-BGDDT.

- He/she meets the standards of professionalism and professional capacity of a grade-I preschool teacher as prescribed in Points a, b and c Clause 4, Article 5 of Circular No. 01/2021/TT-BGDDT and Clauses 4 and 7, Article 1 of the Circular No. 08/2023/TT-BGDDT.  In which, emulation titles and forms of reward as prescribed in Clause 7, Article 1 of Circular No. 08/2023/TT-BGDDT must be emulation titles and forms of reward achieved during the period of teaching as a grade-II preschool teacher or in an equivalent position.

- He/she meets requirements for the period of teaching as a grade-II preschool teacher (including the period of teaching in an equivalent position) according to the provisions of clause 8 Article 1 of Circular No. 08/2023/TT-BGDDT.

Duties of Commune Police in inspection of fire protection from December 16, 2024

On October 31, 2024, the Minister of Public Security of Vietnam promulgates Circular No. 55/2024/TT-BCA amending certain Articles of Circular No. 141/2020/TT-BCA; Circular No. 150/2020/TT-BCA; Circular No. 88/2021/TT-BCA and Circular No. 06/2022/TT-BCA.

According to Circular No. 55/2024/TT-BCA, duties of commune police in inspection of fire protection as prescribed in Article 6 of Circular No. 141/2020/TT-BCA are amended as follows:

Commune police has the following duties under their authority assigned or delegated to manage areas or facilities: 

- Advise leaders to directly organize situation understanding and basic investigation to serve the management of fire protection and rescue in the areas or facilities assigned to manage;

- Perform basic professional work and work of recording and producing statistics of professionalism serving the management of fire protection and rescue;

- Disseminate laws and knowledge on fire protection and rescue; establish a movement of all people participating in fire protection and rescue;

- Carry out inspections of fire and rescue safety according to prescribed procedures; monitor and urge the overcoming of risks of loss of safety and violation of regulations on fire protection and rescue;

- Provide professional training in fire protection and rescue; provide guidance on development and practice of firefighting plans and rescue plans of facilities;

- Understand the situation, cooperate in supporting fire fighting and rescue work when fires occur in the areas or facilities assigned to manage; participate in investigating and resolving fires and explosions according to the provisions of law;

- Inform, report and perform other tasks assigned by superiors;

- Handle administrative violations of fire protection, temporarily suspend, advise on suspension of operations of facilities, motor vehicles, households, and individuals that do not ensure fire safety according to regulations.

- Inspect the fire protection responsibilities of heads of agencies, organizations and facilities; Inspect fire safety of facilities, residential areas, households, households engaging in production and business according to Articles 5, 6 and 7 of Decree No. 136/2020 /ND-CP amended in Decree No. 50/2024/ND-CP.

The inspection of fire protection and rescue may be conducted at the same time with the inspection of security and order.

Criteria for classification of public service providers in labor from December 15, 2024

The Minister of Labor, Invalids and Social Affairs promulgated Circular No. 11/2024/TT-BLDTBXH dated October 31, 2024 providing guidance on classification of public service providers in labor, and social service sectors.

To be specific, public service providers in labor are classified through 4 groups of criteria as follows: 

- Criterion group I: positions, functions, tasks;

- Criterion group II: efficiency and quality of work;

- Criterion group III: facilities and equipment;

- Criterion group IV: professional qualifications and skills.

Specific criteria and points are specified in the appendices enclosed with the Circular as follows:

- Appendix I: Table of criteria and points for nursing homes for people with meritorious services.

- Appendix II: Table of criteria and points for social assistance facilities.

- Appendix III: Table of criteria and points for child protection service providers.

- Appendix IV: Table of criteria and points for orthopedic and rehabilitation facilities.

- Appendix V: Table of criteria and points for units conducting technical inspections of labor safety.

- Appendix VI: Table of criteria and points for employment service centers.

- Appendix VII: Table of criteria and points for public service providers in labor relations.

Principles for considering presentation of Vietnamese traditional medicine Hai Thuong Lan Ong Award

On October 29, 2024, the Minister of Health promulgated Circular No. 24/2024/TT-BYT amending Circular No. 16/2020/TT-BYT on standards and guidance for considering presentation of Vietnamese traditional medicine Hai Thuong Lan Ong Award. Principles for considering presentation of Vietnamese traditional medicine Hai Thuong Lan Ong Award are amended as follows:

- The award must be presented in an accurate, open, transparent, fair and timely manner.

- The award consideration must ensure the gender equality.

- Individuals who directly engage in work and have a lot of creativity in work; or individuals with achievements recorded in difficult conditions and with a large scope of influence are given priority in award consideration.

- It has not been proposed to consider presentation of Hai Thuong Lan Ong award to individuals who are within the statute of limitations for disciplinary action or above or the statute of limitations for imposing administrative penalties for violations against regulations on medical examination and treatment; individuals related to cases and matters in which competent authorities are considering disciplinary action; individuals who are in the process of investigation, inspection, and checking of signs of law violations; individuals who have complaints or denunciations being verified and processed; or in cases where individuals related to corruption and reported by media and press agencies that are being verified and clarified.

For cases that have been verified and clarified by competent authorities to be unrelated to cases and matters of violation against discipline, and laws specified in this Clause; and individuals who continue contributing and recording outstanding achievements in traditional medicine, or traditional medicine combined with modern medicine, the award will be considered for presentation according to regulations.

- Individuals who participate in multiple fields of work may only select one field for award consideration.

- An individual who receives a salary and is considered for annual emulation and commendation at any unit may request to be considered for an award at that unit. In case the individual does not receive a salary from the state budget, he/she can request the award consideration through the professional association in the traditional medicine field where he or she is working.

- It is not required to apply standards on scientific and technological tasks, and initiatives to individuals working in border areas, on the sea, on islands, or in areas with extremely difficult socio-economic conditions according to the provisions of the Government and working in detention centers, compulsory education institutions, compulsory detoxification centers, and reformatories.

- Hai Thuong Lan Ong Award is considered to be presented once to qualified subjects according to regulations. The award is not presented posthumously.
