Vietnam: Candidates successful for public public employee positions must come to the public service unit to sign contract within 30 days

This is the main content of Decree No. 115/2020/ND-CP dated September 25, 2020 of Vietnam’s Government on recruitment, utilization, and management of public employees.

Candidates successful for public public employee positions must come to the public service unit to sign contract within 30 days (Illustration)

Article 18 of Decree 115/2020/ND-CP stipulates the process for signing employment contracts and starting work for public employees as follows:

  • No later than 15 days from the date the successful candidate completes their recruitment documents, the head of the recruiting authority or unit must issue a recruitment decision and send it to the successful candidate at their registered address and to the public service unit that will use the public employee, so they can sign the employment contract.

  • Within 30 days of receiving the recruitment decision, the successful candidate must go to the public service unit that will use the public employee to sign the employment contract and start work, unless the recruitment decision stipulates a different timeframe or the recruiting authority or unit grants an extension.

  • If the successful candidate does not go to sign the employment contract and start work within the stipulated timeframe, the head of the public service unit will request the recruiting authority or unit to cancel the recruitment decision.

  • The head of the recruiting authority or unit will consider hiring the next candidate with the closest lower score compared to the candidate whose outcome was canceled.

In cases where there are two or more candidates with equal lower scores, the head of the recruiting authority or unit will decide the successful candidate according to the stipulations in Article 10 of Decree 115/2020/ND-CP (in the case of a competitive examination) or Article 12 of Decree 115/2020/ND-CP (in the case of a selection process).
