Vietnam: 05 notes when processing and disbursing social insurance benefits for military servicemen

Recently, the Ministry of Defense of Vietnam issued Circular No. 136/2020/TT-BQP providing guidance on dossiers, procedures, and responsibilities related to the settlement of social insurance benefits within the Ministry of Defense.

Article 5 of Circular 136/2020/TT-BQP provides several notes in resolving and paying social insurance benefits for military personnel; workers in cryptographic work with wages similar to military personnel; national defense officials, workers, and public employees; contracted laborers in agencies, units, and enterprises under the Ministry of National Defense as follows:

  • The basis for resolving and receiving social insurance benefits is the Social Insurance Book, which reflects the united contributions to the social insurance database centrally managed by the Social Insurance Department of the Ministry of National Defense. All information related to social insurance contributions and benefits must be updated in the social insurance management software system of the Social Insurance Department of the Ministry of National Defense when any changes occur.
  • When resolving social insurance benefits, it is necessary to cross-check the Social Insurance Book with the social insurance database and social insurance benefit dossiers. In cases where social insurance benefits have been resolved, and adjustments need to be made that affect the social insurance database, the database and the Social Insurance Book must be adjusted accordingly. Based on the adjusted database and Social Insurance Book, further adjustments to the social insurance benefits must be carried out as per regulations.
  • In cases where dossiers for resolving social insurance benefits are submitted later than the deadline specified in this Circular, the head of the subordinate unit must provide a written explanation stating the reasons for the late submission and commit to being legally responsible for the contents of the explanation.
  • Annually, agencies, units, and enterprises under the Ministry of National Defense must compile dossiers to resolve and pay demobilization benefits from the social insurance fund for their subordinate non-commissioned officers and soldiers when they are discharged. The decisions, lists, and data of the benefits dossier (on a CD containing the data) must be sent to the Social Insurance Department of the Ministry of National Defense for settlement.
  • The personnel department must appraise the dossier, report to the head of the unit, and introduce the employee to the competent medical examination council of the Ministry of National Defense to assess the reduction in labor capacity, serving as the basis for resolving retirement benefits.
