Regulations on the development of national databases in Vietnam according to Decree 47

Currently, the development of national databases in Vietnam is regulated in Decree 47/2024/ND-CP.

1. Basic elements of the national database in Vietnam

According to Article 8 of Decree 47/2024/ND-CP:

The involved parties include:

- National database administrator;

- Units providing and maintaining data in the national database;

- Units operating the national database information system;

- Parties involved in the connection and sharing of data from the national database.

Related activities include:

- Development of national databases information system;

- Initial data collection;

- Data maintenance and updates;

- Maintenance and operational work on the national database information system;

- Connecting, exploiting and using data;

- Data management.

The related components include:

- Data;

- Database;

- Database management system;

- Overall architecture, including data architecture, system architecture, and other architectural documents;

- National database information system.

The Minister of Information and Communications provides detailed guidance on the basic elements of the national database.

2. Development of national databases in Vietnam

According to Article 9 of Decree 47/2024/ND-CP:

Development of national databases includes the following activities:

- Designing the data architecture in line with the e-Government Architecture Framework of Vietnam;

- Setting up the national database information system including technical infrastructure, hardware, platform, software, and applications through investment or service leasing or the use of existing information systems, ensuring no duplication, overlap, or waste;

- Collecting data, establishing data, standardizing data to form the database;

- Other activities as prescribed by law.

Collecting and establishing data to serve the construction of the national database

- Data and information to serve the construction of the national database are collected and established from the following sources:

+ Direct collection from professional activities through information systems, platforms, applications, professional software;

+ Exploiting and sharing from other national databases;

+ Extracting, selecting and synchronizing relevant data from specialized databases and shared databases of Ministries, Central authorities and local authorities;

+ Digitizing and standardizing information from management records of state agencies;

+ From other sources as prescribed by specialized law.

Requirements for collecting, establishing, and standardizing data to serve the construction of the national database

- Creating data in the national database must uniformly use common code tables issued by competent authorities;

- National database administrators are not allowed to collect or organize the re-collection of data or request organizations or individuals to provide data again when they already manage or when the data are readily connected and shared by other state agencies, except in cases of needing data for updates or verification purposes or when the data do not meet quality standards or when the law provides otherwise;

- Information can only be created and entered into the national database once it has been verified for accuracy;

- Comply with the provisions on data collection, establishment, and standardization as stated in Decree 47/2020/ND-CP on the management, connection, and sharing of digital data by state agencies.

The construction of the national database must comply with technical standards and norms for IT applications; adhere to investment and IT application regulations; data connection and sharing; information security; cybersecurity and other relevant legal provisions.

3. Managing the national database in Vietnam

According to Article 13 of Decree 47/2024/ND-CP, the regulations are as follows:

- The Government of Vietnam uniformly manages the national database. The Government assigns ministries, ministry-level agencies, and agencies under the Government to be responsible for the national database according to their assigned functions and tasks.

- The data within the national database falls under the state management scope of any agency, which is responsible for ensuring the data is updated and integral.

- Management and administration of national database data include:

+ Data administration as specified in Article 14 of Decree 47/2020/ND-CP;

+ Managing data architecture, including designing and maintaining data infrastructure to support data integration, data quality, and data accessibility;

+ Designing and modeling data management, including identifying data structures and relationships to support processes and objectives for building and exploiting data within the national database;

+ Storing and operating data, ensuring the data is stored efficiently, securely, and supports data availability and extraction performance;

+ Data security, including protecting data from unauthorized access, disclosure, or use, protecting personal information, and ensuring compliance with other data security regulations;

+ Managing data integration and interaction, including connecting and synchronizing data from different sources and ensuring the data within the national database can be connected and shared with databases and information systems of other Ministries, Central authorities, and local authorities;

+ Managing master data including selecting technology, tools, and processes to ensure that master data within the national database is collected, updated, exploited, and used accurately, consistently, and comprehensively;

+ Managing data quality, ensuring data accuracy, completeness, timeliness, and suitability for professional requirements.
