On July 31, 2024, the Minister of Natural Resources and Environment of Vietnam issued Circular 08/2024/TT-BTNMT stipulating the land statistics, examination and the making of land use map in Vietnam
According to Article 3 of Circular 08/2024/TT-BTNMT, the scope of land statistics, examination in Vietnam is regulated as follows:
The scope of land statistics, examination follows the provisions at Clause 1, Article 57 of the Land Law 2024 and is determined as follows:
- Administrative boundaries of each administrative unit level are identified according to the latest administrative boundary records authorized by competent authorities;
- If there is any inconsistency regarding the administrative boundary lines of communes, wards, or commune-level towns (hereinafter referred to as communal-level) between the administrative boundary records and the current management status, the related communal-level administrative units shall jointly determine the area of inconsistency and jointly conduct land statistics, examination in the inconsistent area following the criteria specified in Article 4 of Circular 08/2024/TT-BTNMT.
In areas not determined in the administrative boundary records, the actual administrative unit managing that area shall conduct land statistics, examination;
- For administrative units adjacent to the sea, the scope of land statistics, examination reaches the lowest average sea water line for many years. If the lowest average sea water line for many years, as published by the Ministry of Natural Resources and Environment, does not match the land currently managed and used, land statistics, examination should follow the current status.
For sea areas regulated in Clause 4, Article 190 of the Land Law 2024, where no land allocation or lease decision has been made, concurrently with land allocation for sea reclamation as per Clause 7, Article 72 of Decree 102/2024/ND-CP, land statistics, examination shall classify such areas as unused water surface land.
Additionally, thematic land inventory shall be conducted as required by the state management of land resources during different periods, decided by the Minister of Natural Resources and Environment or the Chairman of the Provincial People's Committee.
+ Develop official documents directing the Provincial People's Committees to conduct land statistics;
+ Collect records, materials, and data related to the previous period's land inventory and the previous year's national land statistics.
- Receive the results of statistics on defense land and security land from the Ministry of National Defense and the Ministry of Public Security of Vietnam respectively. Receive provincial-level land statistics results and direct corrections, complete data, and report land statistics results. Propose the provincial People's Committees review the publication of local land statistics results.
- Process and aggregate national land statistics data and prepare reports as prescribed at points a, b, c, d, and dd, Clause 1, Article 5 of Circular 08/2024/TT-BTNMT.
- Analyze and evaluate the current land use status, the causes of land changes in the statistical year compared to the previous year's land statistics and the previous period's land inventory. Make proposals to enhance land management efficiency nationwide.
- Prepare a national land statistics report with main contents:
+ Implementation situation of land statistics;
+ Evaluation of current land use, analysis of land changes in the statistical year;
+ Proposals and recommendations for strengthening land use management.
- Complete and publish national land statistics results as stipulated in Clause 4, Article 59 of the Land Law 2024.
