Legal statuses of artels, branches, representative offices of cooperatives in Vietnam

According to Article 28 of Decree 92/2024/ND-CP, the legal statuses of artels, branches, representative offices, and business locations of cooperatives, cooperative unions in the Database on cooperative registration in Vietnam include:

(1) "Suspended Business Operations" is the legal status of artels, branches, representative offices, business locations of cooperatives, cooperative unions during the period they are temporarily suspending their business operations according to this Decree.

(2) "Revoked due to Tax Management Enforcement" is the legal status of artels, branches, representative offices of cooperatives, cooperative unions where the district-level business registration authority has decided to revoke the Certificate of Collaboration Group Registration, Certificate of Cooperative Registration, Certificate of Branch/Representative Office Registration based on the recommendation of the tax management authority to enforce an administrative decision regarding tax management.

(3) "In Process of Terminating Operations" is the legal status of artels, branches, representative offices, business locations of cooperatives, cooperative unions where the district-level business registration authority has announced that they are in the process of terminating their operations.

(4) "Terminated Operations" is the legal status of artels, branches, representative offices, business locations where the district-level business registration authority has announced the termination of operations of the collaboration group, branch, representative office, business location.

(5) "Not Operating at Registered Address" is the legal status of artels, branches, representative offices, business locations of cooperatives, cooperative unions, where according to inspections and verifications by the tax authority and related units, the collaboration group, branch, representative office, business location of the cooperative, cooperative union is not found at the registered address. Information on the collaboration group, branch, representative office, business location of the cooperative, cooperative union not operating at the registered address is provided by the tax authority to the district-level business registration authority. The change and termination of this legal status are decided by the tax authority, except for cases where the collaboration group, branch, representative office, business location of the cooperative, cooperative union is in legal statuses (1), (2), (3), and (4). The tax authority is responsible for sending information about the legal status "Not Operating at Registered Address" of artels, branches, representative offices, business locations of cooperatives, cooperative unions to the district-level business registration authority. The district-level business registration authority records and updates the legal status provided by the tax authority into the Database on cooperative registration.

(6) "Active" is the legal status of artels, branches, representative offices, business locations that have been granted the Certificate of Collaboration Group Registration, Certificate of Branch/Representative Office Registration, Certificate of Business Location Registration and do not fall under the above five legal statuses.
